There shall be provided on the premises used for the following purposes in any district at the time any building or structure is constructed... spaces for off-street loading...

For general office, storage uses, furniture stores and home improvement establishments, construction of up to one-third of the number of required off-street parking spaces may be deferred on the condition that all required parking shall be fully designed and depicted on the approved site plan...

For regional shopping malls of at least 500,000 square feet, the off-street parking requirements shall be calculated using the gross leasable area (GLA) of the mall. Regional shopping malls that, at the time of occupancy, are situated on public transit routes and provide bicycle and/or pedestrian facilities... shall be allowed to provide a reduced minimum amount of off-street parking at a rate of one parking space for every 300 square feet of GLA.

The Administrator may waive off-street parking requirements for a single-family detached dwelling proposed on an existing lot of record, upon a determination that (i) the dwelling is not located on a corner lot, (ii) the lot on which the dwelling is located has no access to a public or private alley, and (iii) the lot has fewer than 30 feet of street frontage.

The sidewalks in the Primary and Secondary Downtown Assessment Districts, as defined in Section 25-1 of the Winchester City Code, may be used by proprietors, owners, or tenants of businesses abutting the sidewalks, or outside vendors, subject to the provisions within this Section.

As used herein, 'outdoor dining area' shall mean any group of tables, chairs, benches, and suitable devices maintained for the purpose of sale and/or consumption of food, refreshments, and beverages of all kinds as an extension of a restaurant...

Portable signs shall not exceed six square feet in area.

Businesses abutting sidewalks may apply to use such areas for the display of merchandise for the purpose of attracting customers into such businesses, and not expressly for the sale of such items on display.

Vendors without an adjoining storefront and operating from carts or other portable vending apparatuses may apply for a permit to use sidewalk area in the Primary and Secondary Downtown Assessment Districts.

Special Events in the Primary and Secondary Downtown Assessment Districts shall be governed by the provisions of Chapter 14, Article IX of Winchester City Code.

Any solar energy system that is a principal use shall require a written decommissioning agreement, pursuant to Virginia Code § 15.2-2241.2 and reasonably satisfactory to the Zoning Administrator, which agreement shall provide for financial assurance to the City of such decommissioning.
