A Type D buffer yard shall be required in accordance with section 5-400. In considering a conditional use permit request for an asphalt plant, the board shall specifically consider and set standards for height, dust, and noise.
In the A-R district, the following standards shall apply: screening, height, dust, noise, hours, maintenance.
Custom manufacturing general: meet principal structure requirements, all activities enclosed.
Maximum square footage: 3,000 sq ft. No custom manufacturing establishment shall be located on lot containing less than three acres. The site shall front directly on a public street. The establishment shall be accessory to a single-family dwelling. When adjoining residential use within 100 feet, Type B buffer yard.
Maximum square footage: 3,000 sq ft. When adjoining residential use within 100 feet, Type B buffer yard.
Landfill: min parcel 20 acres industrial, 100 acres sanitary, Type D buffer, master plan, annual audit.
Minimum parcel size for an industrial or construction debris landfill = 20 acres. Minimum parcel size for a sanitary landfill = 100 acres. A Type D buffer yard shall be provided.
Mining: excavations 50 ft from property lines, 100 ft from R-1/R-2/Business, 200 ft from dwellings, 200 ft from ROW, 600 ft for machinery.
Excavations shall be confined to areas distant at least 50 feet from all adjoining property lines, at least 100 feet from R-1/R-2/Business, 200 feet from dwellings, 200 feet from right-of-way, and buildings with machinery 600 feet from residential districts.
Scrap and salvage: 200 ft from public street, 500 ft from boundary if adjoining residential.
No scrap and salvage service shall be established within 200 feet of a public street. All junk, salvage and wrecking yards shall be located at least 500 feet from residential district boundaries.
Alternate discharge sewage: only for pre-existing single-family, >300 ft from sewer, discharge to year-round stream, permit max 5 years.
A conditional use permit request shall only be considered when the residence is located more than 300 feet from an existing or proposed public sewer line, or when 300 feet or less, is otherwise unable to connect due to topography.
Amateur radio towers: accessory structure, setback 40% of height from residential, max height 200 ft by right.
The maximum height permitted by right for an amateur radio tower shall be 200 feet. Any tower which exceeds this height may be permitted only after obtaining a special exception permit.
Communication tower: setback 40% of height from residential, 50 ft from road ROW, 25 ft otherwise, co-location allowed if height increase <=5 ft, >125 ft require CUP.
Minimum setback from base of tower to residential structure = 40% of height. Setback from road right-of-way 50 ft, other 25 ft. Towers in excess of 125 ft require CUP.
Outdoor gathering: >2000 people require special use permit, max 3 gatherings per year, lighting directed away.
No more than three outdoor gatherings per year. Where more than 2,000 people anticipated, special use permit required.
The purpose of requiring a conditional use permit is to ensure consistency with the Comprehensive Plan and appropriate land use.
