General provisions
314 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
For each small cell facility up to five small cell facilities on a single permit application the fee shall be $100.00, and for each additional small cell facility over five small cell facilities on a single permit application the fee shall be $50.00.
The installation of small cell facilities on alternative support structures shall be permitted in all districts, subject to the following conditions: (a) The small cell facility shall not extend more than 5 feet above the height of the alternative support structure. (b) The small cell facility shall not exceed 3 cubic feet in volume.
Any wireless support structure or wireless facility permitted pursuant to this section and which has not been used for wireless services for a continuous period of 12 months shall be deemed to be abandoned and shall be removed from the premises within 90 days of such abandonment.
The following temporary events shall be exempt from the provisions of this chapter: (a) Block parties... (b) Garage sales... (c) Seasonal sales... (d) Charitable events... (e) Construction activities... (f) Emergency activities...
A temporary event as defined in Section 30-1220 shall be exempt from the provisions of this chapter and shall not require a certificate of zoning compliance.
The home occupation, whether located in the dwelling unit or in an accessory building, shall not occupy an area greater than the equivalent of 25 percent of the enclosed and heated floor area of the dwelling unit or more than 500 square feet, whichever is less.
A home occupation shall be permitted in any dwelling unit, subject to the following conditions: (a) The home occupation shall be conducted entirely within the dwelling unit and shall not occupy more than 25 percent of the floor area of the dwelling unit. (b) The home occupation shall be conducted only by persons residing in the dwelling unit, and no more than one nonresident employee shall be permitted. (c) The home occupation shall not involve the sale of goods or services on the premises, except that goods produced on the premises may be sold. (d) The home occupation shall not involve the use of equipment that creates noise, vibration, glare, fumes, odors, or electrical interference that is detectable from the exterior of the dwelling unit. (e) The home occupation shall not involve the parking of commercial vehicles on the premises, except that one commercial vehicle not exceeding 1 ton rated capacity may be parked on the premises. (f) The home occupation shall not involve the display of signs, except that one sign not exceeding 2 square feet in area may be displayed on the premises. (g) The home occupation shall not involve the receipt of clients, customers, or patients on the premises, except that clients, customers, or patients may visit the premises by appointment. (h) The home occupation shall not involve the use of the dwelling unit for the storage of materials, goods, or equipment that is visible from the exterior of the dwelling unit.
The following provisions shall apply to home occupations in all districts in which they are permitted by the use of regulations set forth in this chapter:
The provisions of this division shall be applicable to buildings and structures situated in any district and located within a designated floodplain.
Parking decks and parking garages located within a floodplain shall be designed and constructed so as to minimize the risk of flood damage, including the elevation of the lowest floor to or above the base flood elevation.
District regulations prohibiting parking or related circulation of vehicles within portions of parking decks and parking garages located along a principal street frontage shall not be applicable to portions of such structures located below the elevation of the 100-year flood, provided that such parking spaces located along a principal street frontage shall be screened from view from the street by structural material of not less than 45 percent opacity.
For buildings located within a floodplain, the building height shall be measured from the base flood elevation, rather than from the average elevation of the finished grade at the front of the building.
Buildings located within a floodplain shall be designed and constructed so that the building façade fenestration, including windows and doors, is located at or above the base flood elevation.
The number of short-term renters over the age of 18 occupying or present within any short-term rental shall not exceed the lesser of (i) eight persons, or (ii) the maximum number permitted by the most recent edition of the Virginia Uniform Statewide Building Code.
A short-term rental shall be permitted in any dwelling unit, subject to the following conditions: (1) The short-term rental shall be the primary residence of the owner or operator. (2) The short-term rental shall not exceed 30 consecutive days for any single rental. (3) The short-term rental shall not exceed 90 days in any calendar year. (4) The short-term rental shall comply with all applicable building, fire, and health codes. (5) The short-term rental shall not involve the provision of meals or other services to guests.
The following conditions are applicable to all short-term rentals in all districts:
The short-term rental shall be located on the same lot as the short-term rental operator's primary residence... Only one short-term rental shall be permitted on any lot.
The following conditions are applicable to all short-term rentals within the R-1, R-2, R-3, R-4, R-5, R-5A, R-6, R-7, R-8, R-43, R-48, R-53, R-63, R-73, R-MH, RO-1, RO-2, and RO-3 districts.
A property with an emergency housing, transitional housing, or permanent supportive housing use shall be located no more than 2,640 feet from a public transit stop.
Emergency housing, transitional housing, and permanent supportive housing uses shall be subject to the following regulations: (a) Location: permitted in districts set forth in Article IV. (b) Occupancy limits: determined by Director. (c) Staffing: adequate. (d) Security: adequate. (e) Maintenance: good condition. (f) Complaints: respond.
