• Court-ordered abatement period6 months

  any such violator shall abate or remedy the violation within a period of time as determined by the court, but not later than six months of the date of admission of liability or finding of liability.

• Appeal period for temporary/recurring violations15 days

  an appeal must be filed within 15 calendar days of receipt of a notice of a violation involving the following: a. Construction of a fence, structure, planting, or landscaping in violation of section 130-56; b. Installation of signage in violation of the requirements of Article IV of this chapter; c. Failure to enclose a trash dumpster in accordance with section 130-60; d. Permitting a junkyard in any zone in violation of section 130-5; e. Vehicle storage in violation of section 130-62; or f. Failure to operate in accordance with the performance standards for any use listed under Article III, Division 2 of this chapter.

• Appeal period for other violations30 days

  Unless otherwise specified in section 130-601(d)(4), all notices of violation shall have a 30 calendar day right of appeal.

• Civil penalty for each additional summons500 usd

  any violation of the following requirements of this chapter, not resulting in injury to any persons, shall be punishable by a civil penalty of $200.00 for the initial summons and $500.00 for each additional summons.

• Civil penalty for initial summons200 usd

  any violation of the following requirements of this chapter, not resulting in injury to any persons, shall be punishable by a civil penalty of $200.00 for the initial summons and $500.00 for each additional summons.

• Maximum total civil penalties5,000 usd

  nor shall a series of such violations arising from the same set of operative facts result in civil penalties, which exceed a total of $5,000.00.

• Maximum criminal fine for misdemeanor violation1,000 usd

  any violation of the requirements of this chapter, with the exception of the subdivision ordinance located in Division 3, Article I, or the DCSM shall be deemed a misdemeanor and, upon conviction thereof, shall be punishable by a fine of not more than $1,000.00.

• Reasonable period of remediation before civil penalty10 days

  Before a civil penalty is imposed, however, the city shall issue a written warning providing a reasonable period of remediation not to exceed ten calendar days.
