The Board of Zoning Appeals shall have the power to grant, upon appeal or original application in specific cases, such variance from the terms of this chapter provided the burden of proof shall be on the applicant for a variance to prove by a preponderance of the evidence that the application meets the standard for a variance and the criteria set out in this section.

Each day that a violation continues shall constitute a separate offense.

The penalty for any one violation shall be a civil penalty of not more than $200 for the initial summons and not more than $500 for each additional summons.

In addition to the civil penalties set forth in § 18-854, any violation of this Chapter may be subject to criminal penalties as set forth in the Code of Vienna.
