General provisions

Sec. 66-40(e)(39)2 standards

The minimum setback from any property line shall be equal to the height of the tower... The tower shall be set back a minimum of 1.5 times the height from any occupied structure on an adjacent property.

Sec. 66-40(e)(40)2 standards

The minimum setback from any property line shall be 25 feet for ground-mounted systems. The maximum height of a ground-mounted system shall be 15 feet

Sec. 66-40(e)(41)3 standards

Accessory structures shall be set back a minimum of 5 feet from any property line. The maximum height of an accessory structure shall be 20 feet. The maximum floor area of an accessory structure shall be 1,000 square feet

Sec. 66-40(e)(42)2 standards

The maximum height of a fence or wall in the front yard shall be 4 feet. The maximum height of a fence or wall in the side or rear yard shall be 6 feet

Sec. 66-40(e)(43)3 standards

Sec. 66-40(e)(44)1 standards

Parking areas shall be screened from adjacent residential properties by an opaque fence or vegetative buffer a minimum of six feet in height.

Buffering shall be provided between incompatible uses, and shall consist of an opaque fence or vegetative buffer a minimum of six feet in height.

Sec. 66-40(e)(5)2 standards

Outdoor storage and/or display of goods, supplies, materials, or heavy equipment shall be located to the rear of the principal building. Outside storage areas shall not exceed 25 percent of the total site area.

Sec. 66-40(e)(6)3 standards

Fuel pumps shall be at least 20 feet from any property line. No more than 40 percent of their business sales and promotion can be generated from the sale of cigarettes, in any form.

Sec. 66-40(e)(7)12 standards

The minimum lot area for a campground shall be seven acres. Maximum density shall be ten sites per gross acre. All campgrounds shall be served by town water and sewer facilities.

Sec. 66-40(e)(8)3 standards

Minimum lot size: One half (0.5) acre, lots in B-1 are exempt. Parking shall be provided as follows: B-1 districts are exempt from the parking requirements, designated arrival and departure zones shall be located adjacent to the day care center in such a manner that children do not have to cross vehicle traffic aisles to enter or exit the center, and arrival and departure area shall include at least one parking/stacking space per ten children.

Sec. 66-40(f)(1)1 standards

Processes, equipment operations and goods for sale shall be limited to those that do not adversely impact use of adjoining and adjacent zoning lots which are within 600 feet, because of odor, dust, smoke, gases, vapors, noise, light, vibration, refuse matter, or water-carried waste.

Additions and other exterior structural modifications shall be consistent with the materials and colors of the primary structure on site.

Sec. 66-40(f)(2)4 standards

If the solar energy facility is ground-mounted or not flush-mounted on a principal or accessory building, the panel height shall not exceed 15 feet. The lowest surface of any panel shall be a minimum of four feet above the finished grade on which the panel is located.

Sec. 66-40(f)(3)14 standards

The minimum area of a utility-scale solar facility shall be two acres, and the maximum area shall be less than 200 acres. The minimum setback to property lines of parcels with dwellings shall be 200 feet. The minimum setback to all other property lines shall be 150 feet. The maximum height of the lowest edge of the photovoltaic panels shall be ten feet as measured from the finished grade. The maximum height of primary structures and accessory buildings shall be 15 feet as measured from the finished grade at the base of the structure to its highest point, including appurtenances.
