General provisions

Vietnamese Potbellied Pigs, Juliana Pigs, or veterinarian-certified similar breeds as defined below may be kept as pets in the C-1 (conservation), A-1 (agriculture), RE-1 (residential estates) and all residential zoning districts, provided that a conditional use permit shall be required to keep such animals in the R-TH-1, R-MF-1 and R-MF-2 districts. Livestock projects for educational purposes shall be permitted in A-1 and all residential districts with the exception of the R-TH-1, R-MF-1 and R-MF-2 districts.

Construction and maintenance of beehives for the purpose of beekeeping is permitted in single-family and two-family residential districts other than R-TH-1 as indicated in section 6-2102 of this Code.
Any lawful use, building or structure existing on the effective date of this ordinance or existing at the time of any amendment of this ordinance may be continued even though such use, building or structure does not conform with all of the requirements of this ordinance.
An approved preliminary site plan shall be valid for a period of five (5) years, provided that the developer: (a) Submits a final site plan within three (3) years of such approval...
Any final site plan which was lawfully approved before the effective date of this ordinance... shall be valid for a period of not less than five (5) years from the date of approval.
Lawfully nonconforming churches in the B-5 district may only be expanded with a conditional use permit.
Any building permit issued under this section shall expire if the enlargement or alteration of the nonconforming building or structure is not completed within two years of the date the permit was issued.
No expansion shall exceed 1,000 square feet of gross floor area or the maximum lot coverage, whichever results in fewer square feet of expansion.
Any nonconforming building or structure... damaged by any casualty, to an extent not exceeding fifty (50) percent of its assessed value... may be restored within two (2) years after such destruction or damage
A nonconforming building or structure... damaged by any casualty... to an extent exceeding fifty (50) percent of its assessed value... shall not be reconstructed unless the nonconforming building is a single-family or two-family dwelling... in which event it may be reconstructed within two (2) years
An owner may seek approval from the director of development and permits... for an adjustment in the number of stories provided that the director determines that the proposal is consistent with seventy-five (75) percent of the existing dwellings within two hundred fifty (250) linear feet of the subject property
If a lawful nonconforming use is discontinued for more than two (2) years, it shall be deemed to be abandoned.
Contiguous lots under the same ownership that each have a lot width of less than forty (40) feet in residential zoning districts, except R-6 and R-SFA, and thirty seven (37) feet in lot width and less in the R-6 and R-SFA zoning districts shall be considered merged into one lot
Merged lots in the R-6 and R-SFA zoning districts may be subdivided or resubdivided to provide a minimum of thirty-seven (37) feet in lot width
Where the property involved in a rezoning application is three hundred (300) or more acres in gross area, a preapplication conference shall be required.
A preliminary and final site plan shall be required for any construction, use, change in use or other development in all zoning districts; provided, however, that no such plan shall be required for those instances listed in subsection (B).
A phase I environmental site assessment, prepared in compliance with the specifications in the Chesapeake Public Facilities Manual, shall be required for every proposed development that involves any land disturbance for residential, assembly, day care, group home, recreation, school, library, or similar use where exposure to contaminated soil or water would pose a threat to the public health, safety and welfare;
The following developments are exempt from the requirement for a complete preliminary and final site plan: 1. The construction or location of any single-family detached dwelling or two-family dwelling on an existing or platted lot not occupied by any other dwelling. 2. Any accessory structure to a single-family or two-family dwelling. 3. Any agricultural activity except as otherwise provided in this zoning ordinance. 4. A change in or expansion of a use on an existing site other than a modification or expansion regulated by section 17-111, unless... 5. Deposit and contouring of fill on land... 6. Any permitted use of a temporary nature for a period not to exceed one (1) year.
The preliminary site plan application shall contain the following information: ... (including) existing topography at a maximum of ten (10) foot contour intervals ... dimensioned to at least the following standards for accuracy: Boundary, setback and zoning lines: one foot per one thousand (1:1,000) feet; Existing structures, utilities and other topographic features: within five (5) feet; Proposed structures, roads, parking lots and other improvements: within five (5) feet.
Final site plans, together with amendments thereto, shall be prepared by a professional engineer, or land surveyor with a 3(b) license, licensed to practice in the commonwealth of Virginia.
