104 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
Land may be used or occupied and buildings, structurally altered or erected, may be used or changed in use only after a certificate of occupancy has been issued by the administrator.
Where permitted by this chapter, the location of hotels, motels, mobile home parks, commercial amusement parks, hospitals, mobile homes, airports, borrow pits, sanitary fill method of garbage disposal, public utilities, refuse sites and other permitted uses shall require, in addition to the zoning permit and certificate of occupancy, a conditional use permit.
A site plan shall be required for all structures which contain more than four residential units or are for other than agricultural purposes.
No zoning permit shall be issued for the construction, reconstruction, enlargement or alteration of any building or structure unless the following minimum standards and improvements are provided: (1) front on public street, (2) access to public water/sewer where available, (3) driveways paved, (4) parking areas paved, (5) sidewalks, (6) stormwater management, (7) erosion control.
Buffer yards shall be required along the side and rear property lines of all nonresidential uses that abut residential districts. The width of the required buffer yard shall be determined by the intensity of the proposed use.
Plantings required by this section shall be provided in accordance with: (1) evergreen shrubs 24 inches at planting, ultimate 6ft, one per 3 linear feet; (2) small evergreen tree 6ft, ultimate 15ft, one per 5 linear feet; (3) large evergreen tree 8ft, ultimate 50ft, one per 15 linear feet.
All dumpsters for recycling and refuge storage shall be screened on all sides by an opaque enclosure that should match the building and has a minimum height of six feet and nothing should exceed the height of the enclosure area.
When a new, expanded or redesigned parking area is required or is proposed adjacent to a public right-of-way, a landscaped planting strip shall be established between the parking area and the adjacent right-of-way. The required landscaped planting strip shall have a minimum width of ten feet to accommodate the required plantings. When buffer yards as specified in this section are not required, an eight-foot wide landscaping planting strip shall be provided between all parking areas and adjacent properties.
The following minimum standards for interior parking area landscaping shall be met for all new, expanded or redesigned parking areas containing 10,000 square feet or greater of impervious area: (1) at least one deciduous tree per 10 spaces, (2) planting islands min 9 feet wide between every 15 spaces, one tree per island.
All landscaped areas shall be provided with an available water supply with at least one hose bib located within 150 feet of all planted areas. All required or provided trees, shrubs and other plant materials must be replaced during the first available planting season if they die on the premises within the five-year or less maturity period.
The requirements of this section shall be applied equally to all properties but may be modified or waived by the administrator where the intent of this section is preserved and where proposed developments of the new land use meets any of the following guidelines: (1) natural features achieve same intent, (2) buffer yard >15% of parcel, (3) property lines abut another jurisdiction.
No freestanding light fixtures shall exceed 35 feet in height above grade, except for publicly owned fixtures and where possible, the light fixtures may be limited to 20 feet in height above grade. Lighting intensity at the property line shall not exceed one footcandle.
No commercial-type vehicle, defined as any vehicle with a curb weight exceeding 9,000 pounds, shall be parked or stored in an R-E, R-1, R-2, R-3, or MHR zoning district...
All parking areas, access aisles and driveways shall be paved with a dust-free all-weather surface such as asphalt, concrete, or other hard surface, except as permitted by the administrator: ...
The minimum width of a driveway shall be ten feet for a single lane and 20 feet for a double lane. Parking spaces shall have a minimum width of nine feet and a minimum depth of 18 feet...
In all residential districts there shall be provided either in a private garage or within the parking lot two parking spaces for single-family dwellings and one parking space per each bedroom for multifamily apartment units.
Stacking spaces shall be provided for any use having a drive-through facility or having drop-off and pick-up areas. ... Stacking spaces shall be a minimum of nine feet in width by 20 feet in length to accommodate box delivery trucks.
All offstreet loading spaces and their aisles and driveways shall not be reduced in any manner except upon approval by the administrator... Retail sales, automobile dealerships and restaurants shall provide one loading space up to 15,000 square feet; two spaces 15,001 to 40,000 square feet; ...
The location of permanent mobile home parks shall require, in addition to the zoning permit and certificate of occupancy, a conditional use permit issued by the board of supervisors.
