This article establishes the Steptoe's District as the downtown overlay district, as an overlay over existing C-1, and was approved by town council on March 20, 2006.
Nonconforming uses: abandonment after 2 years, repair limit 10%, restoration thresholds 50% and 75%, restoration time 12/18 months, nonconforming lots allowed if setbacks met.
Variances may be granted only upon findings of undue hardship, not shared generally, and no detriment to adjacent property.
Parking space means an area not less than ten feet wide by 20 feet long for each automobile or motor vehicle, such space being exclusive of necessary drives, aisles, entrances, or exits, and being fully accessible for the storage or parking of permitted vehicles.
There shall be provided at the time of erection of any main building or at the time any main building is enlarged, minimum off-street parking space with adequate provisions for entrance and exit by standard sized automobiles. Two hundred square feet (ten feet by 20 feet) of lot or floor area shall be deemed parking space for one vehicle.
On the same premises with every building, structure or part thereof, erected and occupied for uses involving the receipt or distribution of vehicles, materials or merchandise, there shall be provided and maintained on the lot adequate space for standing, turning, loading and unloading services in order to avoid interference with public use of the streets and alleys.
All appliances for dispensing gasoline installed outside of enclosed buildings shall be located not less than 14 feet from the street line.
Fences shall not exceed a height of six feet, as measured from the topmost point thereof to the ground or surface, along the centerline of the fence, in a commercial or residential zone, except that fences may be permitted to a height above six feet with a conditional use permit.
In the case of corner lots in residential districts, there shall be no planting, fence or obstruction to vision more than three feet in height and less than 20 feet from the intersection of two street lines.
In any residential district, the signs in this section shall be permitted when the main use itself is permitted.
Signs permitted within a commercial district shall be erected or displayed only on such walls of a building facing a street, alley or parking area, or as roof signs or freestanding signs upon the lot, subject to the following provisions as to size and location and not to exceed a total of 200 square feet for all signs of any business.
Billboards and general advertising signs are prohibited in all zones.
Zoning permits for temporary trailer parks may be issued by the zoning administrator, subject to the following conditions: ... minimum area of 2,000 square feet be provided for each space.
No trailers or houses on wheels, whether used for living quarters or business, shall be built, erected, or placed for use in any part of the town.
Development or redevelopment of land lying within RPAs and RMAs designated by the council shall comply with all federal, state and county erosion and sediment control requirements, best management practices and the performance standards for development or redevelopment.
The criteria given in this section shall apply specifically within RPAs and supplement the general performance standards in section 54-485.
These provisions shall apply to all privately and publicly owned lands within the jurisdiction of the Town of Kilmarnock and identified as areas of special flood hazard according to the flood insurance rate map (FIRM) that is provided to the Town of Kilmarnock by FEMA.
The floodway district is in an AE zone and is delineated, for purposes of this article, using the criterion that certain areas within the floodplain must be capable of carrying the waters of the one-percent annual chance flood without increasing the water surface elevation of that flood more than one foot at any point.
