General provisions
120 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
The primary entrances of each principal multifamily dwelling shall face a dedicated public street or the limits of a private parking unit. Adequate lighting will be provided. All open areas shall be maintained by the owner.

A foundation survey shall be obtained for new structures, renovations, or additions that require a foundation or footer inspection. Survey may be waived on parcels of three acres or larger if structure is more than 40 feet from all property lines.

Maximum number of occupants shall be no more than two individuals over the age of 12 per bedroom and maximum number of occupants shall be no more than eight adults and 14 total occupants. There shall be no more than 25 short-term rental permits issued in the Town at any time.
Fifteen of such permits may be issued in the Tourism District. This area runs along Spotswood Trail/Avenue from First Street to Clarke Avenue, and then, north to Gibbons Avenue and B Street and south to Highway 33.
All accessory apartments shall be clearly secondary and accessory to the primary dwelling unit. Minimum size 300 sq ft. Max 40% of primary floor area. One per lot. Owner occupancy 9 months. Four off-street parking spaces total.
The minimum size of an accessory apartment shall be 300 square feet. In no event shall the floor area of an accessory apartment exceed 40% of the existing floor area of the primary dwelling. Only one accessory apartment shall be allowed per lot or parcel. Four off-street parking spaces total are required for the primary dwelling and the accessory apartment.
Placement of temporary portable storage containers shall require a container permit if placed for longer than 30 days. No container shall exceed 40 ft length, 9 ft width, 9 ft height. Prohibited on lots without principal structure.
No container shall exceed 40 feet in length, nine feet in width, and nine feet in height. Containers shall comply with all setback requirements such as that of an accessory building based upon the zoning district in which it is placed unless otherwise authorized by the Zoning Administrator.
In evaluating the proposed special exception, the governing body shall address the following concerns: (a) The effect of the proposed special exception, on existing and projected traffic volumes in the neighborhood. (b) The current and future need for the proposed use in the Town of Elkton. (c) The character of the existing neighborhood and the effect of the proposed use or special exception on existing property values. (d) Compatibility with surrounding uses. (e) The consistency with the intent of this chapter and the Comprehensive Plan, the public interest, and all other provisions of law and ordinances of the Town of Elkton. (f) The proximity of dwellings, churches, schools, parks, or other places of public gathering. (g) The probable effect of the proposed use on the peace and enjoyment of people in their homes. (h) The preservation of cultural and historical landmarks and trees. (i) The probable effect of noise and glare upon the uses of surrounding properties. (j) The contribution, if any, such proposed use would make toward the deterioration of the area and neighborhoods.
If the amendment sought is to change the district designation of land on the Zoning Map to R-8, then an application for approval of a master plan pursuant to § 110-609F(3) shall accompany the application for amendment.
Any zoning permit shall automatically expire six months from the date of issuance if the person, firm, or corporation to which the permit was issued has not clearly demonstrated that the permit is being exercised for the purpose for which it was issued, or if the work so authorized is suspended or discontinued for a period of one year.
A certificate of occupancy shall be required in advance of occupancy or use of: (1) A building hereafter erected. (2) A building hereafter altered so as to affect height, or the side, front, or rear yard dimensions. (3) A change of type of occupancy or use of any building or premises.
The Board of Zoning Appeals shall consist of five regular members and one alternate member who shall be appointed by the Circuit Court of Rockingham County. A quorum shall be at least three members. A favorable vote of three members of said Board shall be necessary to reverse any order...
No such variance shall be authorized by the Board unless it finds: (a) That the strict application of this chapter would produce undue hardship. (b) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. (c) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variation.
Any person or persons jointly or severally aggrieved by any decision of the Board... may present to the Circuit Court of Rockingham County a petition specifying the grounds on which aggrieved within 30 days after the filing of the decision in the office of the Board.
For all subdivisions, all streets shall have, as a minimum, a right-of-way width of 50 feet and a pavement width of 30 feet.
