General provisions

Section 36.3754 standards

All structures shall be located a minimum of 100 feet from any residential district.

Section 36.375 (Veterinary hospital/clinic)2 standards

Any treatment rooms, cages, pens, or kennels shall be maintained within a completely enclosed soundproof building.

All structures and fuel storage tanks shall be located a minimum of 200 feet from any residential district.

Section 36.385 (Bulk fuel storage and distribution)4 standards

Bulk storage of fuel shall comply with National Fire Protection Association (NFPA), U.S. Environmental Protection Agency, and any other applicable federal, state, and local standards.

No junkyard, salvage yard, or automotive wrecking yard or graveyard shall hereafter be established with any portion of its area within 150 feet of a public street, road, or highway.

Section 36.4(a)

the provisions of this Ordinance shall apply to all property within the unincorporated territory of the County of Essex, Virginia, with the exception that any property held in fee simple ownership and used by the United States of America or the Commonwealth of Virginia shall not be subject to the provisions contained herein.

Section 36.4(d)

This Ordinance shall not be deemed to interfere with or abrogate or annul or otherwise affect, in any manner whatsoever, any easements, covenants, or other agreements between parties; provided, however, that pursuant to the Code of Virginia, § 15.2-2315, whenever the requirements of this ordinance are at variance with the requirements of any other lawfully adopted statute, regulations, or ordinances, the most restrictive, or that imposing the higher standards shall prevail.

Section 36.4(e)

If any section of this Ordinance incorporates by reference any state statute or regulation, then the ordinance incorporates future amendments of the state statute or regulation.

Section 36.4008 standards

The minimum required area for the use shall be one acre.

Section 36.400 (Broadcasting or communication tower)14 standards

The maximum height of any Broadcasting and Communication Tower shall be made a condition of the conditional use permit. No facility shall be greater than 125 feet.

Section 36.4012 standards

All parking areas shall be enclosed by a fence, wall, or landscaped screen not less than four feet in height where adjacent to a residential district.

No motor vehicle work shall be permitted in association with a parking facility except under emergency service work.

The use shall be limited to a period not to exceed 180 days in any calendar year.
