1General provisions

Allowable land uses, building intensity and/or residential densities, and permit requirements within a PD (Planned) zoning district shall be determined by the Council through the adoption of a Master Plan in accordance with Section 19.42.060.
Unless exempt under Section 19.52.022.B.2, new gas stations shall be prohibited on any parcel zoned Planned District (PD)
The minimum size for this zone shall be 150 acres. Building height shall not exceed four stories above finished grade. a minimum of 560 parking spaces shall be provided. the total density upon final buildout shall not exceed 130 residential units.
The B overlay zoning district is applied to areas within the historic Baylands, excluding lands that have been legally filled or legally developed.
Buffers between tidal areas and developed uses... shall be a minimum width of 100 feet from mean highest high water.
The height limit within the D overlay district shall be 35 feet with exceptions as provided in Section 19.20.070 C (3).
The F1 overlay is applied to lands within a primary floodway, including water channels and adjacent flood plains. Allowable land uses shall be limited to boat docks, with Use Permit approval.
The F2 overlay is applied to lands within a secondary floodway, including the portion of a natural floodway between the limits of the F1 zone and where flood inundation may occur and flood depths and velocities are low.
The F3 overlay district is applied to land within a 100-year flood plain.
The H overlay zoning district is intended to protect areas and structures identified by the community as historically significant elements that contribute to Novato's cultural, social, economic, political, aesthetic, architectural heritage, identity and character.
Residential density in the AHO Overlay district shall be zero. However, notwithstanding any other provision of this title relating to density, in the event that a project complies with the requirements of subsection F. 3 through 7 below, the residential density shall be twenty (20) to twenty-three (23) dwelling units per acre as set forth in Housing Element Program 9B.
Fences, walls, and hedges shall comply with the height limitations shown in Table 3-1.
Use Permit approval (see Section 19.42.050), in addition to a required grading permit, shall be required before any grading or stockpiling of materials is commenced on any site, except that a Use Permit shall not be required if one or more of the following conditions apply: ...
The height of structures shall not exceed the more restrictive of the following, as applicable: the height limit established by the applicable zoning district, the height restrictions for sloping sites, and the height limits for fences and walls.
These requirements apply to all development proposed on sites designated by the Scenic Resources Map in the General Plan. Design Review (Section 19.42.030) shall be required for all projects within these areas.
A non-residential land use proposed on a site adjacent to a residential zoning district use shall provide screening at the parcel boundary as follows: The screen shall consist of plant materials and a solid, decorative wall of masonry or similar durable material, a minimum of six feet in height.
All structures shall comply with the setback requirements of the applicable zoning district established by Article 2, and with any special setbacks established for specific uses by this Zoning Ordinance, except as otherwise provided by this Section.
All projects requiring discretionary approval shall be reviewed for potential energy conservation measures. Passive heating and cooling opportunities should be incorporated into single-family residential subdivisions and multi-family residential projects whenever possible.
Multi-family residential projects, with five or more units shall provide solid waste and recyclable material storage areas as follows: Each dwelling shall be designed to provide an indoor area for the indoor storage of solid waste and recyclable material prior to its placement in a common storage area. A minimum of three cubic feet shall be provided for the storage of solid waste and a minimum of three cubic feet shall be provided for recyclable material.
The Art Project shall have a value of not less than one-third of one percent of the construction cost of the completed development project.
