General provisions

§ 160-1521 standards

No more than three inoperable vehicles shall be stored on any open lot in any district

§ 160-1531 standards

No property owner or tenant may cause to be kept on any lot trash, junk, weeds or litter of any kind.

§ 160-15420 standards

Landscaping, trees and plant material shall be planted in a growing condition... The provisions of this section shall apply to all new development and changes of use, additions and expansions which increase the intensity of existing development a minimum of 3,000 square feet.

No more than one person other than the immediate family residing in the dwelling shall be engaged in such occupation. § 160-1572 standards

It is the intent of this chapter to permit these nonconforming uses and structures to continue until they are removed but not to encourage their survival.

A parking space shall be a minimum of nine feet wide by 20 feet in length.

§ 160-1592 standards

An off-street loading space shall be a minimum of 20 feet wide by 60 feet long.

For the purpose of this chapter, the incorporated areas of the City of Galax, Virginia, are hereby divided into the following districts: Residential Mobile Home R-MH

§ 160-1601 standards

Each owner of apartments or a commercial, industrial or public use shall provide and maintain solid waste disposal containers to meet the requirements of the occupants.

§ 160-160.15 standards

The minimum lot depth (setback) for any lot from the base of the tower to any property line adjacent to any residential district from any dwelling on any lot used for dwelling purposes other than a lot in any residential district shall be equal to 120% of the proposed tower height.

§ 160-160.21 standards

A locality shall not require that a special exception, special use permit, or variance be obtained for any small cell facility installed by a wireless services provider or wireless infrastructure provider on an existing structure

§ 160-162B1 standards

No building or other structure shall be erected, moved, added to or structurally altered, nor any land used or occupied, without a zoning permit issued by the office of the Zoning Administrator.

§ 160-1659 standards

A conditional use permit may be granted, provided that the Planning Commission finds that: (1) The proposed conditional use is designed, located and operated so that the public health, safety and welfare will be protected. (2) The proposed conditional use will not adversely affect other property in the area in which it is located. (3) The proposed conditional use is within the provision of conditional uses, as set forth in this chapter. (4) The proposed conditional use conforms to all applicable provisions of this chapter for the district in which it is to be located and is necessary for public convenience in that location. (5) The proposed use must have direct access on a public road which can safely and adequately handle the automobile and truck traffic generated. (6) Satisfactory storm drainage can be provided and there must be adequate safeguards to prevent soil erosion on the site and erosion and sedimentation on the neighboring downhill and downstream properties during and after development. (7) There is a satisfactory plan and method for sewage disposal. No effluent shall be discharged into any stream prior to having at least secondary treatment. (8) There is suitable provision for the protection of privacy on adjoining property which is now in residential use or which may develop in residential use under the provisions of this chapter. In this section, 'protection of privacy' shall mean effective screening against both visual intrusion and noise. (9) In the case of manufacturing, there shall not be discernible at any property line of the tract on which the use is located any dust, smoke, odor, noise or glare that results from the operation of the manufacturing use. (10) In the case of quarry and mining operations, where permitted as a conditional use, there must be a satisfactory plan for reclamation of the land and restoration of the natural landscape.

§ 160-1657 standards

A conditional use permit may be granted, provided that the Planning Commission finds that: the proposed use must have direct access on a public road; satisfactory storm drainage; satisfactory sewage disposal; protection of privacy; no dust, smoke, odor, noise or glare for manufacturing; reclamation for quarry.

§ 160-1664 standards

The minimum permitted size for any PUD shall be five contiguous acres. The permitted density, in dwelling units per gross acre, shall not be more than 10 dwelling units per gross acre. The required open space shall not be less than 50% of the total gross area of the PUD. The required developed recreation space shall not be less than 10% of the total gross area of the PUD. The maximum height of any building or structure in a PUD District shall be 55 feet.

§ 160-1667 standards

The minimum permitted size for any PUD shall be five contiguous acres. The permitted density shall not be more than 10 dwelling units per gross acre. Required open space not less than 50% of total gross area. Maximum height 55 feet.

§ 160-4

The provisions of this chapter shall apply to all land within the corporate limits of the City of Galax, Virginia.

§ 160-51 standards

In their interpretation and application, the provisions of this chapter shall be held to be the minimum requirements for the promotion of the public health, safety, morals and general welfare of the residents of Galax.

§ 160-6

Where the conditions imposed by any provisions of this chapter upon the use of land or buildings or upon the height or bulk of buildings are either more restrictive or less restrictive than comparable conditions imposed by any other provision of this chapter or of any other law, resolution, ordinance, rule or regulation of any kind, the regulations which are more restrictive shall apply.
