The boundaries of the several districts are hereby established as shown on the zoning district map... Any question as to the location of a boundary shall be determined by the board of appeals as provided in article XXVII.

§ 1.3 Annexations

In case any territory has not specifically been included within one district or another, or may hereafter become a part of the incorporated area of Franklin by annexation or otherwise, such territory shall automatically be classified in the RC district until reclassified as provided herein.

§ 2.148 standards

All storage for mini-storage warehouses shall be within a completely enclosed building. The minimum distance between warehouse buildings shall be twenty-five feet (25'). The maximum length of any single storage building shall not exceed two hundred (200') feet.

§ 2.156 standards

No more than one person not residing in the dwelling shall be engaged in such occupation in the dwelling. The use of the dwelling unit for the home occupation shall be clearly incidental and subordinate to its use for residential purposes by its occupants, and not more than 25 percent of the floor area of the dwelling unit shall be used in the conduct of the home occupation.

The operation of mobile food units when permitted by a specific zoning district shall be permitted by an administrative permit approved by the zoning administrator... The City will limit the number of operational mobile food units to 12 per year... Mobile food units shall operate only on developed and occupied property within the business and industrial zoning districts and will cease operations by 9pm... Mobile food units shall be parked at least 100 feet away from any residential dwelling.

§ 21A.73 standards

In the event of a natural disaster or when state of emergency is declared by the city, state, or federal government, (1) The Commission or Commission staff may authorize temporary disaster-related repairs in order to weatherproof or stabilize a damaged building/structure (waiver shall not relieve the applicant/property owner of making permanent repairs that meet the established guidelines). (2) The immediate restoration or maintenance of any existing above-ground utility structure is hereby authorized as long as repair results in no exterior change from the appearance before the disaster or state of emergency. (3) The Commission may waive all application deadline and notification requirement pertaining to disaster-related repairs.

§ 21A.82 standards

Any person aggrieved by any decision of the Commission may appeal such decision to the City Council, provided that the appeal is filed within fourteen (14) calendar days from the date of the Commission's decision... Any person aggrieved by a final decision of the City Council may appeal to the local circuit court by filing a petition at law... within thirty (30) days after the final decision is rendered by the City Council.

§ 26.2(a)1 standards

Before any building or premises or part thereof is used, which is hereafter created, erected, changed, converted or enlarged in use or structure, a zoning certificate shall be obtained from the zoning administrator.

§ 26.2(b)1 standards

A fee of $25.00 shall be charged to the applicant for a zoning certificate.

§ 26.32 standards

Any person, firm or corporation who violates any of the provisions of this ordinance for which a penalty is not otherwise specified shall, upon conviction thereof, be guilty of a misdemeanor punishable by a fine of not less than $10.00 nor more than $1,000.00.

§ 27.11 standards

The circuit court of Southampton County is hereby requested to appoint a board of zoning appeals for the City of Franklin consisting of seven residents of the city in accordance with Code of Virginia, § 15.2-2308.

§ 27.2(2)(a)1 standards

when owing to special conditions a literal enforcement of the provisions of this ordinance will result in unnecessary hardship provided that the spirit of the ordinance shall be observed and substantial justice done

§ 27.2(2)(c)1 standards

In authorizing a variance the board may impose such conditions regarding the location, character and other features of the proposed structure or use as it may deem necessary in the public interest

§ 27.3(2)1 standards

an applicant shall post the sign or signs provided to him or her by the zoning administrator providing notice of the application on the affected parcel or parcels of land in a location or locations clearly visible from adjacent public streets or places within three days from the filing of an application

§ 27.4(4)1 standards

The same or substantially the same application shall not be considered by the board within a year of date of the original application.

§ 27.51 standards

Such appeal shall be taken within 30 days after the decision appealed from by filing with the zoning administrator, and with the board, a notice of appeal specifying the grounds thereof.

§ 27.62 standards

The board shall fix a reasonable time for the hearing of an application or appeal, give public notice thereof as well as due notice to the parties in interest and decide the same within 90 days of the filing of the application or appeal.
