General provisions

Multi-family dwellings shall be designed with special attention to the compatibility of adjacent land uses, topography, existing vegetation, building height, orientation, and other similar factors.
No more than eight (8) townhouses shall be constructed contiguously.
The provisions of this chapter shall apply to all property within the corporation limits of the town with the exception that any property held in fee simple ownership by the United States of America or the commonwealth shall not be subject to the provisions contained herein.
If any nonconforming use (structure or activity) is discontinued for a period exceeding two (2) years after the enactment of this chapter or amendment thereto, it shall be deemed abandoned and any subsequent use shall conform to the requirements of this chapter.
On any building devoted in which or in part to any nonconforming use, work may be done in any period of twelve (12) consecutive months on ordinary repairs or on repairs or replacement of nonbearing walls, fixtures, wiring or plumbing to an extent not exceeding twenty (20) percent of the current replacement value of the structure; provided, that the cubic content of the structure as it existed at the time of passage or amendment of this chapter, shall not be increased.
A nonconforming structure to be extended or enlarged shall conform with the provisions of this chapter.
If a nonconforming building or use is damaged or destroyed by fire, natural disaster or other act of God, such building may be repaired, rebuilt or replaced to eliminate or reduce the nonconforming features to the extent possible, without the need to obtain a variance.
Whenever the boundaries of a district are changed, any uses of land or buildings which become nonconforming as a result of such change shall become subject to the provisions of this article.
Where a lot of record at the time of adoption or amendment of this chapter has less area or width than herein required in the district in which it is located and the owner of such lot does not own any other parcel or tract adjacent thereto, the lot may nevertheless be used for a single-family dwelling or for any other non-dwelling use permitted in the district in which it is located; provided, that a variance of setbacks and/or side and rear yard requirements, if required, is obtained from the board of zoning appeals.
Nothing in this section shall be construed to prevent the landowner or homeowner from removing a valid nonconforming manufactured home from a mobile or manufactured home park and replacing that home with another comparable manufactured home that meets the current HUD manufactured housing code.

Minimum pavement width shall be twenty-two (22) feet, exclusive of parking.

minor terminal streets (culs-de-sac) designed to have one (1) end permanently closed shall serve no more than twenty-five (25) lots. Each cul-de-sac must be terminated by a turnaround of not less one hundred (100) feet diameter.
the maximum length of blocks shall be twelve hundred (1200) feet and the minimum length of blocks on which lots have frontage shall be five hundred (500) feet.
concrete monuments four (4) inches in diameter or square, three (3) feet long, with a flat top shall be set at all street corners at all points where the street line intersects the exterior boundaries of the subdivision and at right angle points and points of curve in each street.
All other lot corners shall be marked with iron rod not less than one-half (½) inch in diameter and twenty-four (24) inches long, or iron rod not less than one (1) inch in diameter and twenty-four (24) inches long.
Pipestem lots, also known as flag lots, are prohibited.
the town requires the dedication of land and construction of a 5' sidewalk on the property in the B-1, B-2, and B-3, R-1, R-2, and R-3 zoning districts being subdivided or developed when one (1) of the following applies: 1. The land fronts on an existing street; 2. Is adjacent to an existing sidewalk; 3. Is reasonably required by the proposed development, or 4. Is in the adopted comprehensive plan.
Easements of not less than twenty (20) feet in width shall be provided for drainage, water, sewer, power lines and other utilities in the subdivision when required by the agent.
