General provisions

116 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.

Sec. 8-62 standards

Where... a lawful use exists... which use is made no longer permissible... such use may be permitted so long as it is not abandoned for more than two years and so long as the structure in which such use is located is maintained in its then structural condition.

Sec. 8-72 standards

Any sign which was lawfully in existence... which does not conform to the provisions herein... may remain. No nonconforming sign shall be enlarged, extended, structurally reconstructed, or altered in any manner; however, such nonconforming sign may be repaired...

Sec. 8-8

Nothing in this appendix shall be construed to prevent the land owner or home owner from removing a valid nonconforming manufactured home from a mobile or manufactured home park and replacing that home with another comparable manufactured home that meets the current HUD manufactured housing code.

Sec. 8-9

On any structure devoted in whole or in part to any nonconforming use, ordinary maintenance work, or the repair or replacement of nonbearing walls, fixtures, wiring, or plumbing, may be done, provided the cubic content of the building... shall not be increased.

Sec. 9-223 standards

No structure shall be erected, constructed, reconstructed, moved, demolished, added to, or structurally altered until a zoning permit has been issued by the zoning administrator.

Sec. 9-232 standards

It shall be unlawful to use or occupy any structure or land, individually or in combination, in whole or in part, in which or on which a new use is created or an existing use is changed, converted, enlarged, or moved, until a certificate of occupancy is issued.

Sec. 9-32 and 9-344 standards

A site plan shall be required to be submitted with a zoning permit application... at a scale no smaller than one inch equals 50 feet.

Sec. 9-50(d)1 standards

The owners of property... may voluntarily proffer, in writing, reasonable conditions... shall adhere to the following standards: The rezoning itself shall give rise for the need for the conditions; The conditions shall have a reasonable relation to the rezoning; ...

Sec. 9-62 to 9-695 standards

An application for a conditional use permit shall be in writing... Construction shall begin or the use of land for which a conditional use permit has been obtained shall commence within 12 months from the effective date of such permit; otherwise, such permit shall become void.

Sec. 9-64, 9-673 standards

The use is compatible with the character and appearance of the surrounding neighborhood... Construction shall begin or the use of land... shall commence within 12 months... discontinued for a period of two consecutive years... shall become void.

Sec. 9-704 standards

The board of zoning appeals may grant a variance... when... literal enforcement... will result in unnecessary hardship... The concurring vote of three members... shall be necessary... shall not grant a variance to permit a use in a district not authorized.

Sec. 9-703 standards

The board of zoning appeals may grant a variance from the terms of this appendix as will not be contrary to the public interest when, owing to special conditions, a literal enforcement of the provisions of this appendix will result in unnecessary hardship... The board shall authorize a variance only if it makes all five of the following findings...

Sec. 9-71 and 9-724 standards

Such notice of appeal shall be filed with the zoning administrator, and with the board, within 30 calendar days from the date of the decision for which review is sought... The board of zoning appeals shall make its decision on an appeal within 90 calendar days of the filing of the appeal.

Sec. 9-71, 9-722 standards

Such notice of appeal shall be filed... within 30 calendar days... may file with the clerk of the circuit court a petition... within 30 calendar days after the final decision of the board.

Sec. 9-80 to 9-843 standards

Violating, causing, or permitting the violation of, or failure to comply with any of the requirements of, this appendix... shall be unlawful and is subject to... Criminal sanctions... Each day that any violation continues after notification by the zoning administrator shall be considered a separate offense.

Temporary family health care structure section (unnumbered)4 standards

Only one such structure shall be permitted on a lot; removed within 60 days; annual certification.
