General rules1 standards

All distances shall be measured horizontally and shall be the shortest distance between the points for which the distance specified.

Sec 21-111 standards

No building or other structure shall be constructed, reconstructed, erected, enlarged, structurally altered, moved, or converted to accommodate a different use, nor shall any use of a building, structure or land be established or changed until zoning approval has been granted by the zoning administrator.

Sec 21-121 standards

Development or redevelopment of properties identified on the adopted Chesapeake Bay preservation area map, or otherwise identified as lying within Chesapeake Bay preservation areas, shall comply with the requirements of this chapter and those set forth in Article III, Chesapeake Bay Preservation Area of Chapter 4.1, Environmental Protection.

Sec 21-131 standards

A conditional use permit granted by the town council shall be required for any uses for which a conditional use permit is specified by the use regulations or other provisions of this chapter.

Sec 21-141 standards

The official zoning map, which shall be located in the office of the town manager, shall be the final authority as to the current zoning status of land, structures, and other uses in the town.

Sec 21-146 through Sec 21-1513 standards

Structures to be erected or land to be used shall be for the following uses: Single-family detached dwellings... The permitted density for dwelling units in a PUD District shall not be more than twelve (12) units per gross acre. All structures in the PUD District shall be set back at least thirty-five (35) feet from the boundary of a PUD District or sixty (60) feet from the centerline of any street... The maximum height of any building or structure in a PUD District shall be thirty-five (35) feet.

Sec 21-155 through Sec 21-161, Sec 21-16613 standards

Structures to be erected or land to be used shall be for the following uses: Mobile homes... The permitted density of any PMH development shall not be more than five (5) dwelling units per acre. The minimum lot size for each mobile home lot shall be twenty-eight hundred (2,800) square feet... The maximum height of any building or structure other than a mobile home shall be thirty-five (35) feet. Open space shall comprise at least twenty-five (25) percent of the total gross area of the PMH development.

Sec 21-156 through 21-17010 standards

The minimum permitted size for any PMH development shall be five (5) contiguous acres. The permitted density ... shall not be more than five (5) dwelling units per acre. Minimum lot size 2,800 sq ft. Open space at least 25%.

Sec 21-171 through 21-1796 standards

PSC Districts shall be permitted only in areas designated in the comprehensive plan as commercial land use. Structures to be erected or land to be used shall be for the following uses... Maximum height 45 feet. Minimum landscaped open space 2%.

Sec 21-173 through Sec 21-1767 standards

Structures to be erected or land to be used shall be for the following uses permitted with a shopping center of two hundred thousand (200,000) square feet or less... The minimum permitted size for any PSC District shall be five (5) contiguous acres. The minimum landscaped open space in any PSC District shall not be less than two (2) percent of the gross area of the lot. No building or structure in a PSC District shall exceed a height of forty-five (45) feet.

Sec 21-179.1 through 21-179.910 standards

The minimum permitted size for a POB District shall be three (3) contiguous acres. Minimum lot width 150 ft. Front yard 50 ft, side yards 30 ft, rear yard 50 ft. Max height 45 ft. Open space at least 20%.

Sec 21-179.3 through Sec 21-179.910 standards

Structures to be erected or land to be used shall be for the following uses: Accessory uses as defined... The minimum permitted size for a POB District shall be three (3) contiguous acres... The minimum size of lots in a POB District shall be established in conjunction with the development plan approved by the town council, provided that no lot shall be less than one hundred fifty (150) feet in width. A front yard of not less than fifty (50) feet shall be provided... No building or structure in a POB District shall exceed a height of forty-five (45) feet... Not less than twenty (20) percent of each lot shall be devoted to open space

Sec 21-1911 standards

If any nonconforming use (structure or activity) is discontinued for a period exceeding two (2) years, after the enactment of this chapter, it shall be deemed abandoned and any subsequent use shall conform to the requirements of this chapter.

Sec 21-1922 standards

The construction or use of a nonconforming building or land area for which a permit was issued legally prior to the adoption of this chapter may proceed, provided such building is completed within one year, or such use of land established within thirty (30) days after the effective date of this chapter.

Sec 21-1931 standards

Normal repairs and routine maintenance of nonconformities shall be permitted unless such repairs increase the extent of nonconformity or are otherwise expressly prohibited by this Zoning Ordinance.

Sec 21-1941 standards

Whenever the boundaries of a district are changed, any uses of land or building which become nonconforming as a result of such change shall become subject to the provisions of this article.

Sec 21-1952 standards

A nonconforming structure shall not be extended or enlarged unless its use is changed to conform with the provisions of this chapter for the uses allowed in the district.

Sec 21-1951 standards

A single-family residential structure that is located in an RR-1, R-1, R-2, R-3 residential zone or in the HE Zoning District and is classified as nonconforming by reason of not complying with all the requirements of this chapter, may be enlarged if the enlargement itself meets all setback, side yard or rear yard requirements.

Sec 21-1952 standards

A nonconforming residential structure may be replaced by a new residential structure, on the same lot, provided however, that the replacement structure shall meet all set back, side yard and rear yard requirements. In such a case, a performance bond shall be provided the town to ensure the original structure is demolished and the original site landscaped within two (2) months after a certificate of occupancy is issued for the replacement structure. No existing lot area, lot width or yard shall be reduced to less than required for single-family dwelling use in the Residential District R-3.

Sec 21-1961 standards

Any lot of record at the time of the adoption of this chapter which is less in area or width than the minimum required by this chapter may be used when the requirements of this chapter regarding setbacks, side and rear yards, are met.
