  • Initiation of zoning amendment

    Any such amendment may be initiated by resolution of the board of supervisors, or by motion of the planning commission, or by petition of the owner, contract purchaser with the owner's written consent, or the owner's agent therefor, of the property which is the subject of the proposed zoning map amendment, addressed to the board of supervisors.

  • Board of supervisors action deadline1 year

    The board of supervisors shall take action on a request for amendment within one (1) year of the date of filing; otherwise the amendment shall be deemed approved.

  • Development plan conformity with proffered conditions

    Upon approval, any site plan, subdivision plat or development plan thereafter submitted for the development of the property in question shall be in substantial conformity with all proffered statements, plans, profiles, elevations or other demonstrative materials, and no development shall be approved by any county official in the absence of said substantial conformity.

  • Planning commission report deadline90 days

    Failure of the commission to report ninety (90) days after the first meeting of the planning commission after the proposal has been referred to the planning commission shall be deemed approval.

  • Limitations on proffered conditions

    Such conditions shall not include mandatory dedication of real or personal property for open space, parks, schools, fire departments or other public facilities not otherwise provided for in the subdivision ordinance; Such conditions shall not include payment for or construction of off-site improvements except those provided for in the subdivision ordinance; No condition shall be proffered that is not related to the physical development or physical operation of the property; and All such conditions shall be in conformity with the comprehensive plan.

  • Proffered conditions must be in writing

    As a part of a petition for rezoning or amendment of the zoning district map the owner or owners of the property involved may, prior to a public hearing before the board of supervisors, voluntarily proffer in writing such reasonable conditions...

  • Notice of public hearings before the commission shall be given by publishing the time, place and nature of the hearing once a week for two (2) successive weeks in a newspaper published or having general circulation in the county... The public hearing shall be held not less than six (6) nor more than twenty-one (21) days after final publication.

  • One-year limitation on reconsideration1 year

    No application for a change in zoning which has been denied by the board of supervisors shall be reconsidered within one (1) year from the date of such denial...
