- Appeal to Circuit Court deadline30 days
Any appeal of the decision of the governing body denying or approving an issuance of a special use permit may be taken by any aggrieved party to the Circuit Court. Any such appeal shall be filed within 30 days of the action of the governing body.

Within 180 days of the filing by the planning staff of the findings report required by Subsection D(1) above with the Commission, unless a longer period shall have been established by mutual agreement between the governing body, the applicant and the Commission in a particular case, the Commission shall review the proposed application and report its findings and recommendation to the governing body.

Activities or uses approved by a special use permit which are discontinued for a period of more than two consecutive years shall not be reestablished on the same property unless a new special use permit is issued in accord with this chapter.

Any special use permit granted shall be null and void two years after approval by the governing body if the use or development authorized by the permit is not commenced to a degree that, in the opinion of the Zoning Administrator, clearly establishes the intent to utilize the granted special use permit.
