General provisions
25 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
Buildings shall be located 35 feet or more from any street right-of-way. Buildings may be erected up to two and one-half stories and 35 feet in height.
Principal permitted uses: open undeveloped spaces, publicly-owned parks and recreational facilities. Setbacks: 35 ft from street ROW. Height: 2.5 stories/35 ft.
The Chesapeake Bay Preservation Area Overlay District shall apply to all lands identified as CBPAs as designated by the town council and as shown on the town zoning map.
Public utilities. Structures shall be located five feet or more from any street right-of-way. Buildings may be erected to a height not to exceed two and one-half stories or 35 feet.
The regulations contained in this article shall apply to all zoning districts in the town, unless expressly superseded by the specific provisions set forth herein.
Nonconforming uses may continue; abandonment after one year; repairs and maintenance allowed; expansion must conform.
It is recognized in this chapter that particular uses are not necessarily incompatible with the uses traditionally associated with standard zoning districts if the proper mitigating conditions are enacted along with the proposed exception. Therefore, such uses have been designated as special exceptions.
If, in any district established under this chapter, a use is not specifically permitted, and an application is made by a property owner to the administrator for such use, the administrator shall refer the application to the planning commission, which shall make its recommendations to the town council within 30 days.
Newly annexed portions of the town shall be zoned or rezoned immediately to the residential R1-A classification until the town planning commission and town council have had an opportunity to conduct appropriate studies for a period not to exceed six months and take the steps necessary to place the land in the most suitable category.
Prior to the initiation of an application by the owner of real property within the town by the owner, the owner's agent or any entity in which the owner holds an ownership interest greater than 50 percent whether such application is for a special exception, special use permit, variance, rezoning or for clearance to obtain a build permit from the county, the zoning administrator shall, on behalf of the council, require the applicant to produce satisfactory evidence that any delinquent town real estate taxes or any other town charges which constitute a lien against the subject property, including, but not limited to, liens for unpaid water and/or sewer charges, have been paid in full.

Whenever the standards set forth in this chapter are at variance with the requirements of any other lawfully adopted statutes, rules, regulations, deed restrictions, covenants or ordinances, the most restrictive, or that imposing the highest standards shall govern.

Buildings or structures shall be started, reconstructed, enlarged or altered only after a zoning permit has been obtained from the zoning administrator.
