These provisions shall apply to all privately and publicly owned lands within the jurisdiction of Cape Charles and identified as areas of special flood hazard identified by the community and areas also shown on the flood insurance rate map (FIRM) or included in the flood insurance study (FIS) that are provided to Cape Charles by Federal Emergency Management Agency (FEMA).
Within any floodway area, no encroachments, including fill, new construction, substantial improvements, or other development shall be permitted unless it has been demonstrated through hydrologic and hydraulic analysis performed in accordance with standard engineering practice that the proposed encroachment will not result in any increase in flood levels within the community during the occurrence of the base flood discharge.

The floodplain districts described above shall be overlays to the existing underlying districts as shown on the official zoning ordinance map, and as such, the provisions for the floodplain districts shall serve as a supplement to the underlying district provisions.

For all properties required to comply with the freeboard elevation, the height allowance or restriction identified in article VI division 3 may be exceeded equal to the freeboard requirement.
The lawful use of a building or structure which existed on September 11, 1990, or which exists at the time of any amendment to this article, and which is not in conformity with the provisions of the overly district may be continued in accordance article II division 4 of this chapter.
