General provisions
136 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
If any non-conforming use (structure or activity) is discontinued for a period exceeding two years, after the enactment of this ordinance, it shall be deemed abandoned and any subsequent use shall conform to the requirements of the ordinance.
All owners or operators of non-conforming uses shall apply to the zoning administrator for a certificate of occupancy within one year after the adoption of this ordinance.
On any building devoted in whole or in part to any non-conforming use, work may be done on ordinary repairs or on repair or replacement of non-bearing walls, fixtures, wiring, or plumbing.
The board of supervisors may... grant to the property owner(s) an exemption from the strict lot size and other zoning requirements for an expansion of the family subdivision for other members of the immediate family provided that the expansion does not increase the land area of the original subdivision by more than 20 percent.
Structures except signs shall be 35 feet or more from any street right-of-way... side yard 15 feet... rear yard 35 feet... corner side yard 25 feet.
If a non-conforming structure or activity is destroyed or damaged in any manner to the extent that the cost of restoration to its condition before the occurrence shall exceed 75 percent of the cost of reconstructing the entire activity or structure, it shall be restored or replaced only if such use complies with this ordinance.
A minimum lot area is not required for utility lots. ... Structures, whether primary or accessory, that are located on utility lots in all zoning districts shall be located ten or more feet from any street right-of-way. The minimum side and rear yard for each structure shall be ten feet.
All developers are required to finance and assist in the preparation of an impact study of his development upon the county.
Any applicant may voluntarily proffer in writing any reasonable conditions... as a part of rezoning or as a amendment to the zoning map.
Alternative discharging sewage systems as defined by state law are prohibited in the county unless the health officer finds that one is needed to serve an existing occupied dwelling.
No person shall sell, offer for sale, store, and display or discharge any fireworks in any filling station... must be a minimum of 100 feet from any gas pumps or propane distribution tank. Fireworks shall be allowed for sale for a period no longer than 30 consecutive days. A 30 foot front setback shall be maintained.
Except as otherwise provided in the district regulations, every lot shall front on an existing public street... frontage shall not be less than required by the regulations of the district. Minimum lot width shall be at least the same distance as the frontage required for the district.
The zoning administrator may grant a variance from any building setback requirement after finding in writing that: (1) strict application would produce undue hardship; (2) hardship not shared generally; (3) not substantial detriment; (4) character not changed.
Water and sanitary sewer hookup is mandatory for new construction... if a water distribution or gravity sewer line owned by Greene County/Rapidan Service Authority is within 350 feet of a boundary line of the property to be served. Water hookup is mandatory in districts B1, B2, B3, M1, M2, PUD, SR. Sanitary sewer hookup is mandatory for all zoning districts.
It shall be unlawful for any person to keep on any property zoned for residential, commercial or agricultural purposes any vehicle which is inoperable, except as follows: on property less than two acres, one inoperable vehicle may be kept if shielded; on property two acres and larger, two inoperable vehicles may be kept if shielded.
A temporary events zoning permit shall be required for temporary events that are planned for or which reasonably may be expected to attract more than 50 persons at any one time. The permit shall be issued for not more than four occasions per year and not more than seven consecutive days. No such activity shall be located closer than 100 feet from the property line that is adjoining or adjacent to a residential, agricultural, or conservation district. Temporary events are permitted only between 7:00 a.m. and 12:00 midnight.
A mobile food unit may be operated in the business and industrial zoning districts. No mobile food unit may be operated on private property without a zoning permit. The permit allows operation at a maximum of three different properties. Hours of operation from 6:00 a.m. to 10:00 p.m. A mobile food unit shall not locate within 100 feet of a residential zoning district or a residential use.
The following uses are permitted at a farm winery... Farm winery events at which not more than 400 persons are in attendance at any time. ... Sound amplification shall be limited in the time range of 10:00 a.m. to 10:00 p.m. EST.
Each farm winery shall be subject to the following: Uses permitted include production, sale, tasting, events up to 400 persons by right; events over 400 require special use permit. Sound from outdoor amplified music limited to 10:00 a.m. to 10:00 p.m. Setbacks per district primary structure. Prohibited: restaurants, helicopter rides.
Farm stands: any permanent structure shall not exceed 1,500 sq ft gross floor area. Farm sales: not exceed 4,000 sq ft. Farmers' markets: no size limit. Parking: one space per 400 sq ft of retail area. No parking space shall be located closer than ten feet to any public street right-of-way. Setbacks per district primary structure.
