General provisions
128 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
All subdivisions shall conform to the requirements of this land development code and the standards contained within this code.
If a nonconforming use is discontinued for a period of 180 days or more, any future use of the land shall conform to the standards of the district in which it is located.
Not more than 30 percent of the gross floor area of a brewpub shall be used for the production of beer.
In zone districts, where permitted, short-term rentals shall be clearly incidental and subordinate to the principal use of a single-family detached or single-family attached dwelling unit on the lot on which the short-term rental is located.
All open off-street parking areas, drives, and storage lots, except parking lots and garages accessory to a single family detached or attached dwelling, shall provide a six-inch concrete curb around the entire perimeter.
The Floor Area Ratio requirements shall only apply to new structures.
If a PUD zone document references design guidelines for the PUD, no PUD permit shall be approved until the design guidelines are finalized and on file with the city.
Areas zoned industrial — Ten (10) years.
Areas zoned commercial — Five (5) years.
Areas zoned agricultural — Five (5) years.
Areas zoned residential — Two (2) years.
Other zoned areas, if any — Two (2) years.
A PUD development permit shall lapse and be of no further force and effect if a building permit application ... has not been submitted within ... two years of the date of approval.
In cases where the applicant requests that the Floor Area Ratio be reduced to zero: a. The property must be 5 acres or more in size;
A decision on a temporary use permit shall be issued no later than 30 days from the date a completed application is received by the city.
The subject property is not located in any floodplain. The area of land disturbance must not be exposed for more than 60 consecutive days without temporary or permanent stabilization.
A height exception shall lapse unless a building permit is issued and construction is substantially completed within three years from the date of approval.
a use-by-permit shall lapse unless a building permit has been issued and construction diligently pursued within two years of approval. In the event no new structure is required to operate the use, then the use-by-permit shall lapse if the use is not commenced within 180 days of the approval. In addition, a use-by-permit shall automatically lapse and have no further effect if the use is discontinued for 180 consecutive days.
A variance shall lapse and have no further effect unless construction has been completed within one year from the date the variance is granted.
if after it is commenced, it is abandoned or discontinued for a period of 180 days or more, then the conditional use permit shall automatically lapse and be null and void.
