  • Civil penalty2,000 dollars

    Any person violating or failing, neglecting or refusing to obey any injunction, mandamus or other remedy obtained pursuant to this Ordinance shall be subject, in the discretion of the court, to a civil penalty not to exceed $2,000.00 for each violation.

  • Conservation plan for erosion impact areas

    The Administrator may require the approval of a conservation plan for any Erosion Impact Area.

  • Inspection stages

    Inspections shall be conducted at the following stages: 1. Prior to commencement; 2. During installation; 3. Upon completion.

  • Maximum administrative fee1,000 dollars

    Fees shall not exceed $1,000.00.

  • Class 1 misdemeanor1,000 dollars

    A violation of this Ordinance shall be deemed a Class I misdemeanor and upon conviction shall be subject to a fine not exceeding $1,000.00 or 30 days imprisonment.

  • Performance bond required

    The Administrator, prior to the approval of any erosion and sedimentation control plan shall require of the applicant a reasonable performance bond with surety, cash escrow, letter of credit, or combination thereof.

  • Erosion and sediment control plan approval

    No person shall engage in any land-disturbing activity until an approved erosion and sediment control plan or agreement in lieu of a plan has been obtained.

  • For single-family dwellings, the plan-approving authority may accept an agreement in lieu of a plan.
