The planning commission ... may review the criteria of this section and waive or modify the regulation for structures on legal nonconforming lots or parcels provided that: (a) There will be no net increase in non-point source pollutant load; and (b) Any development or land disturbance exceeding an area of 2,500 square feet complies with all erosion and sediment control requirements of this subchapter.
