If in established residential districts, exceptional topographical conditions would prohibit or unreasonably restrict use, owner may apply for special use permit allowing subdivision on terms agreed upon.

The town council shall issue the special use permit if it finds that the use will not adversely affect health/safety, not be detrimental to public welfare, and be in accordance with the comprehensive plan.
