• Application requirements

  Application by owner with fee, preliminary site plan, description of use, compatibility statement, and additional info if requested (architectural plans, traffic impact, fiscal impact, parking analysis, photos, environmental impact).

• City Council action

  City Council holds public hearing and approves by majority vote.

• Conditions that may be imposed

  City Council may impose conditions including more restrictive sign standards, additional open space, landscaping, yards, lighting, hours of operation, parking, utilities, right-of-way, compatibility, and renewal/expiration provisions.

• Expiration of special use permitConditional useAllowed only after a discretionary approval — usually a public hearing and a board vote.

  If use or construction not commenced within 18 months, permit expires automatically.

  Extension may be granted for up to 1 year for implementation/completion of improvements.

  Planning Commission must hold public hearing and report recommendation within 90 days; failure to report is deemed approval.

  The proposed use shall be in harmony with the Comprehensive Plan, the intent of the zoning district, and the character of adjacent properties; adequately served by public services; not result in destruction of significant features; and be designed, sited and landscaped to not hinder adjacent development.

  Permit terminates if use ceases for 2 years, or may be revoked for noncompliance with conditions.
