VIOLATION AND PENALTY

Sec. 1101.00. - Authority.#

All departments, officials, and public employees of the City of Buena Vista which are vested with the duty or authority to issue permits or licenses shall conform to the provisions of this ordinance. They shall issue permits for uses, buildings, or purposes only when they are in harmony with the provisions of these regulations. Any such permit, if issued in conflict with the provisions of these regulations shall be null and void.§

Sec. 1102.00. - Complaints regarding violations.#

Whenever a violation of these regulations occurs, or is alleged to have occurred, any person may file a written complaint. Such complaint stating fully the causes and basis thereof shall be filed with the administrator. He shall record properly such complaint, immediately investigate, and take action thereon provided by these regulations.

Sec. 1103.00. - Penalties.#

Any violation, by any person, firm or corporation, whether as principal agent, employee, or otherwise, of the provisions of these regulations shall be a misdemeanor punishable by a fine of not less than $10.00 or more than $1,000.00.§ If the violation remains uncorrected at the time of conviction, the court shall order the violator to abate or remedy the violation in compliance with the zoning ordinance, within a time period established by the courts. Failure to remove or abate a zoning violation within the specified period shall constitute a separate misdemeanor offense punishable by a fine of not less than $10.00 nor more than $1,000.00, and any failure to remove or abate a zoning violation during the succeeding 10-day period shall constitute a separate misdemeanor offense for each 10-day period, punishable by a fine of not less than $100.00 nor more than $1,500.00.
