General provisions
42 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
The town does hereby authorize the county to adopt and apply within the town limits an ordinance for the control of erosion and sedimentation.
The areas in which this article applies are the rural residential, traditional residential (low density) and traditional residential (high density) and any area within 100 feet of such districts.
It shall be unlawful for any person to cause, harbor, commit or maintain, or to suffer to be caused, harbored, committed or maintained any nuisance as defined by the statutes or common law of this state or as defined by this Code or other ordinance of the town at any place within the town or at any place within the area surrounding the town and substantially affecting the town and its citizens.
Minimum dwelling space requirements: 100 sq ft for first occupant, 70 sq ft per additional; sleeping rooms 70 sq ft for one, 50 sq ft per occupant; bathroom 30 sq ft; window area 10% of floor area; egress ceiling 7 ft; smoke detectors required.
It shall be unlawful for any person to maintain, keep or harbor any hog, pig or other animal of the swine family on any premises, whether his own or those of another, anywhere within the town.
It shall be unlawful for any person to leave any horse on any street or in any public place in the town unless such horse be attended by a responsible person capable of exercising control over the horse; nor shall any person permit any horse owned by him or in his charge or keeping to be at large at any public place within the town.
Any person owning or having custody or control of fowl within the town shall provide for such fowl a suitable pen or other enclosure or place of habitation and physical restrictions which prevent the fowl from leaving the premises. It shall be his duty to maintain such place at all times in a safe and sanitary condition, free of excrement and other unsanitary or offensive substances or liquids, and so as not to constitute a hazard to the health or safety of any person or to become a nuisance.
No person shall shoot, trap, snare, poison otherwise kill or maim any wild bird within the town, except that this prohibition shall not extend to birds defined as 'nuisance birds' under Code of Virginia § 3.2-900. No person shall molest the nest or disturb any nesting bird protected under the provisions of subsection (a) of this section.
The comprehensive animal laws as contained in the Code of Virginia 3.2-6500 et seq., as amended, and the Orange County dog ordinance as presently in effect as Ordinance 6-3 and 6-166, as amended shall be fully applicable within the town limits.
It shall be unlawful for any owner or person in control of any animal to: (1) Allow any animal to defecate on the property of another person or business without their consent or the consent of the authorized agent or person having control of the premise; or (2) Allow any animal to defecate on public property. ... defecation by an animal on public property shall not constitute a violation ... if the owner or person having control of the animal immediately removes the material defecated and disposes of it in a safe and sanitary manner.
The owning, keeping, or possessing of any dog which continuously barks in such a manner as to permit sound to be plainly audible across a residential real property boundary for a period of 30 minutes or longer between the hours of 7:00 a.m. and 11:00 p.m. or 15 minutes or longer between the hours of 11:00 p.m. and 7:00 a.m. within the town shall be illegal.
every licensed retail business within the town located within 150 feet of a single-family or multifamily residence, which is located within a single-family or multifamily residential zone, shall close to the public not later than 1:00 a.m. each day and shall not reopen earlier than 5:30 a.m.
The owners of property within the town shall, at any time ordered by the town manager, remove, repair or secure any building, wall, or any other structure that the town manager has determined might endanger the public health or safety of other residents of the town.
The owners of property within the town shall, at such time or times as the governing body through its town manager may prescribe, submit a plan to demolish or renovate any building that has been declared by the town manager to be a 'derelict building.'
No person shall kindle or maintain any bonfire or rubbish fire ... not less than 50 feet from any structure ...
Chimneys, flues or similar devices for conveying products of combustion or hot gases to the exterior of the building shall be maintained in a manner as not to create a hazardous condition.
Where conditions are such as to make smoking a hazard ... the town manager ... is empowered and authorized to order the owner or occupant in writing to post 'No Smoking' signs ...
Any person using a torch or other flame-producing device for removing paint from any building or structure shall provide one fire extinguisher ... and a fire watcher shall remain on the premises for one hour after the torch or flame-producing device has been used.
Roofs, courts, yards, vacant lots and open spaces shall be kept free and clear of deposits or accumulations of waste paper, hay, grass, straw, weeds, litter or combustible waste or rubbish of any kind.
No person shall store in any building or upon any premises in excess of 2,500 cubic feet gross volume of combustible empty packing cases, boxes, barrels or similar containers, or rubber tires, or baled cotton, rubber or cork, or other similarly combustible material without a permit from the town manager or his authorized representative.
