General provisions
10 rules that bind every district rather than one — sign regulations, parking, floodplain and the rest of the code’s citywide chapters.
Where on-lot sewage disposal is proposed on any lot of five (5) acres or less... percolation test... Land in a subdivision which is in a designated floodway or flood fringe shall have the County Floodplain regulations apply to buildings.
Home occupation: total area used may not exceed one-half of first floor area; Screening: strip at least 10 ft wide, planted with shrubs/trees at least 4 ft high, forming a screen at least 6 ft high; Building height measured from average elevation of proposed finished grade at front of building.
Sidewalks four (4) feet side shall be constructed... All utility facilities... shall be located underground throughout the subdivision. In residential districts a buffer strip of at least twenty-five (25) feet...
Mobile home subdivisions shall be located in a zone district where they are a permitted use by right and shall be no less than four (4) acres in size.
Mobile home parks shall be located in a zone district in which they are a permitted use by right and shall be no less than four (4) acres in size.
Mobile unit overnight courts shall be located in a district in which they are a permitted use by right.
Primary Approach Zone – ... free of all structures or buildings and shall be used only for agricultural purposes. Secondary Approach Zone – ... vertical approach of twenty (20) horizontal feet to one (1) vertical foot and no structure or building shall be located in this zone which exceeds the height prescribed by this slope.
Whenever a non-conforming use has been discontinued for a period of six (6) months, it shall not thereafter be re-established, and any future use shall be in conformance with the provisions of this resolution.
No certificate of occupancy shall be issued until final grading has been completed in accordance with the approved final subdivision plat and the lot precovered with soil with an average depth of at least six (6) inches
In no event shall any person residing or utilizing property in a MUD district, as defined by the Bent County Zoning Code, own, keep or harbor more than four dogs of more than six months of age. In all other zoning districts, in no event shall any person own, keep or harbor more than 15 adult dogs or cats, of more than six months of age.
