Height

  • Stepback for second story5 ft

    Any portion of a new primary dwelling unit that exceeds one story must be stepped back by an additional five feet from the ground floor.

  • Deed restriction required

    The owner shall record a deed restriction that prohibits rental for less than 30 days, prohibits nonresidential use, prohibits separate conveyance, and limits development to residential units.

  • Direct utility connection

    Each primary dwelling unit shall have its own direct utility connection to the utility service provider.

  • Fire hazard mitigation

    A lot in a very high fire hazard severity zone shall comply with all MLFPD fire hazard mitigation measures for residential construction.

  • Maximum demolition of existing exterior walls25 pct

    The two-unit project may not involve the demolition of more than 25 percent of the existing exterior walls of an existing dwelling unless the site has not been occupied by a tenant in the last three years.

  • The total floor area of each primary dwelling unit shall be less than or equal to 800 square feet.

  • A two-unit project may only be approved if all nonconforming zoning conditions are corrected.

  • Owner occupancy requirement

    Unless the lot was formed by an urban lot split, there are no owner-occupancy restrictions for long-term rentals of either primary dwelling unit. If one of the primary dwelling units has a legally established JADU, the owner-occupancy requirements specified in Section 17.52.055(c)(5)d shall apply.

  • Primary dwelling units on the lot may not be owned or conveyed separately from each other. Condominium airspace divisions and common interest developments are not permitted.
