  • Appeal period10 days

    Within ten days after any denial, suspension, or revocation of a permit, the individual aggrieved may appeal such action to the city manager.

    The provisions of this section shall not apply to any person engaged solely in the business of entertaining the public by demonstrations of fortunetelling at public places and in the presence of and within the hearing of all other persons in attendance.

    It is unlawful for any individual owner, managing partner, managing officer, or other individual in charge of any fortunetelling establishment to employ any individual who is not at least eighteen years of age.

    Fortunetelling establishments may be open for operation only between the hours of seven a.m. and midnight.

  • Permit display

    Every fortunetelling establishment shall display at all times during business hours the permit issued pursuant to the provisions of this section for such establishment in a conspicuous place.

  • Permit requirement for employees

    It is unlawful for any owner, operator, manager, or permittee in charge of or in control of a fortunetelling establishment to employ any individual to practice fortunetelling who is not in possession of a valid permit to practice fortunetelling.

  • Permit term1 years

    The term of the permit and the term of the business license shall be for one year from the date of issuance.

  • Reapplication waiting period1 years

    Any individual whose permit is denied or revoked may not apply for a permit to operate a fortunetelling establishment or practice fortunetelling in the city for a period of one year from the date of such revocation.

  • Receipt requirements

    Prior to the acceptance of any money or item of value from a client, the fortuneteller shall issue a written receipt to the client, clearly showing the date, name of client, amount, and purpose.

  • Religious exception

    The provisions of this subsection shall not be applicable to any person conducting or participating in any religious ceremony or service when such person holds a certificate of ordination as a minister, missionary, medium, healer, clairvoyant, or similar position from any bona fide church or religious association.

  • Renewal notice period30 days

    A renewal application shall be filed no later than thirty days prior to the expiration of the permit.

  • No fortunetelling establishment or any portion of a building in which the fortunetelling establishment is located shall be used for residential or sleeping purposes.

Signage

  • Services and rate sign1 inch

    Every permittee of a fortunetelling establishment shall post a sign in a conspicuous place ... printed in bold letters not less than one inch in height, listing the services available and the rate to be charged therefor.
