Owners of nonconforming structures, nonconforming uses, or vegetation are required to permit the installation, operation, and maintenance thereon of whatever markings and lights deemed necessary by the Federal Aviation Administration or the Virginia Department of Aviation. No permit shall be granted that would permit a nonconforming use or structure to become a greater hazard to air navigation without a special exception from the Board of Zoning Appeals.

No use shall be made of any land or water that creates electrical interference with navigational signals or radio communication between the airport and aircraft; diminishes the ability of pilots to distinguish between airport lights and other lights; results in glare to pilots using the airport; impairs visibility in the vicinity of the airport; creates the potential for bird strike hazards; or otherwise in any way endangers, or interferes with the landing or maneuvering of, aircraft in the vicinity of or intending to use the airport.

Applications for variances and special exceptions shall contain a determination from the Virginia Department of Aviation as to the effect of the application on the operation of air navigation facilities and the safe, efficient use of navigable air space. Variances allowed only where literal application results in unnecessary hardship and relief not contrary to public interest.

The Airport Safety Management Overlay District (ASM) regulations are intended to protect the general health, safety and welfare by insuring that development will occur to cause no interference with air traffic over the City of Suffolk and, specifically, Suffolk Executive Airport and the Hampton Roads Executive Airport.
