Other

• Public roads exempt

  The construction, maintenance, repair, and replacement of public roads shall be exempt from the provisions of this Part 504, provided that such activities are conducted in accordance with best management practices and applicable state and federal laws and regulations.

• Railroad lines exempt

  The construction, maintenance, repair, and replacement of railroad lines and facilities shall be exempt from the provisions of this Part 504, provided that such activities are conducted in accordance with best management practices and applicable state and federal laws and regulations.

• Silvicultural activities exempt

  Silvicultural activities, including but not limited to the harvesting of timber, the planting of trees, and the construction of logging roads and skid trails, shall be exempt from the provisions of this Part 504, provided that such activities are conducted in accordance with the Virginia Department of Forestry's Best Management Practices for Water Quality; the Virginia Silvicultural Water Quality Law; and any other applicable state and federal laws and regulations.

• Aboveground utility lines exempt

  The installation, maintenance, repair, and replacement of utility lines and facilities where the utility line or facility is installed above ground and the installation is conducted in accordance with best management practices and minimizes impacts on water quality;

• Underground utility lines exempt

  The installation, maintenance, repair, and replacement of utility lines and facilities, including but not limited to water, sewer, gas, electric, and telecommunications lines, where the utility line or facility is installed underground and the installation is conducted in accordance with best management practices;
