A homeowners' association shall be created during the subdivision process when any of the following conditions are proposed: a. Alleys, pedestrian access ways and/or sidewalks that are not maintained by the Virginia Department of Transportation. b. Commonly held parcels or open space are proposed. c. Storm water management infrastructure/best management practices located on a commonly held parcel.
