Any action contesting the decision of the Board approving or failing to approve a proposed special use permit shall be filed within 30 days of the decision with the Circuit Court.

The Board of Supervisors may, after review and recommendation by the Planning Commission, and after proper notice and a public hearing, grant a special use permit where such special use or structure is permitted by the terms of this chapter.
