- Commencement of construction1 year
Construction or operation shall commence within one year of the date of issuance or the conditional use permit shall become void.
- Conditions of issuance
The proposed use will not affect adversely the health or safety of persons residing or working in the neighborhood of the proposed use; will not be detrimental to the public welfare or unduly injurious to property values or improvements in the neighborhood; will not be in conflict with the policies and principles of the City's adopted Comprehensive Plan; adequate public services are or reasonably will be available.
- Public notice requirements
Notice of public hearings shall be published once a week for two successive weeks in some newspaper published or having general circulation in the City, provided that such notice for both the Planning Commission and the City Council may be published concurrently. Such notice shall specify the time and place of a hearing at which persons affected may appear and present their views, not less than five days nor more than 21 days after the second advertisement shall appear in such newspaper.
- Reapplication restriction1 year
No reapplication for a conditional use permit for the same or substantially the same application shall be considered by the governing body within a period of one year from its last consideration.
- Termination upon cessation24 months
Should the use approved by the conditional use permit cease for any twenty-four-month period during the life of the permit, the conditional use permit shall become void.

Conditional use permits may be issued for any of the uses for which a conditional use permit is required by the provisions of this chapter, provided that the governing body, upon a recommendation by the Planning Commission, shall find that: (a) The proposed use will not affect adversely the health or safety of persons residing or working in the neighborhood of the proposed use. (b) The proposed use will not be detrimental to the public welfare or unduly injurious to property values or improvements in the neighborhood. (c) The proposed use will not be in conflict with the policies and principles of the City's adopted Comprehensive Plan. (d) Adequate public services, including streets and other trafficways, utilities, police and fire protection, are or reasonably will be available to support the proposed use.
