- Grazing, haying, and cultivating and harvesting agricultural, forestry or horticultural products
- Conservation, repletion and research activities of the commission, the Virginia Institute of Marine Science, the Department of Game and Inland Fisheries and other conservation-related agencies
- Construction or maintenance of aids to navigation which are authorized by governmental authority
- Emergency measures decreed by any duly appointed health officer of a governmental subdivision acting to protect the public health
- Governmental activity in wetlands owned or leased by the commonwealth or political subdivision thereof

- Permit application contents
The permit application shall include name and address of applicant, detailed description, map, area of fill/excavation, equipment, adjacent owners, cost, purpose, mitigation measures, completion date, and additional materials.
- Bond or letter of credit
The board may require a reasonable bond or letter of credit in an amount and with surety and conditions satisfactory to it.
- Criteria for granting permit
The board shall grant the permit if the anticipated public and private benefit exceeds detriment, conforms with standards, and does not violate purposes.
- Decision within 30 days
The board shall make its determination within thirty (30) days of the hearing. If the board fails to act within that time, the application shall be deemed approved.
- Vote required for approval
Approval of a permit application shall require the affirmative vote of three (3) members of a five-member board or four (4) members of a seven-member board.
- Permit expiration date
No permit shall be granted without an expiration date established by the board.
- Permit required for non-permitted uses
Any person who desires to use or develop any wetland within this city, other than for the purpose of conducting the activities specified in section 27.5-23, shall first file an application for a permit.
- Nonrefundable processing fee
A nonrefundable processing fee shall accompany each permit application.
Not later than sixty (60) days after receipt of a complete application, the wetlands board shall hold a public hearing.
- Suspension or revocation
The board may suspend or revoke a permit if the applicant has failed to comply with conditions or exceeded scope.
- Permit does not affect zoning
No permit granted by a wetlands board shall in any way affect the applicable zoning and land use ordinances of the city.
