The holder of a special exception permit for wireless telecommunications facilities shall indemnify, defend, and hold harmless the Town, its officers, officials, employees, agents, and volunteers from and against any and all claims, demands, losses, damages, costs, expenses, and liabilities, including reasonable attorney's fees, arising out of or in connection with the construction, installation, operation, maintenance, repair, or removal of the wireless telecommunications facilities, except to the extent caused by the negligence or willful misconduct of the Town.

(1) On existing towers or other structures without increasing the height of the tower or structure. (2) On Town-owned properties. (3) On properties in areas zoned for industrial use (I-Industrial). (4) On properties in areas zoned for business use (GC General Commercial, CC Core Commercial, NC Neighborhood Commercial). (5) On properties in areas zoned for agricultural use (A-1 Agricultural). (6) On properties in areas zoned for residential use (R-1 Medium Density Residential, R-2 Multifamily Residential, MHP Mobile Home Park).

In no event shall the height of a telecommunications tower exceed 199 feet, unless the applicant demonstrates to the satisfaction of the Town that a greater height is necessary to provide functionally reliable service primarily and essentially within the Town and that no alternative exists that would be less intrusive.
- NIER certification deadline
The certification shall be provided to the Town no later than January 31 of each year.
- Performance security required
Prior to the issuance of a special exception permit for wireless telecommunications facilities, the applicant shall provide the Town with a performance security in an amount determined by the Town to be sufficient to ensure the proper construction, installation, and maintenance of the wireless telecommunications facilities.
- Permit validity period5 years
The special exception permit shall be valid for a period of five years from the date of issuance, subject to recertification as provided in § 171-137.

All equipment shelters, cabinets, and other accessory structures shall be designed to be architecturally compatible with the surrounding environment and shall be screened from view to the maximum extent feasible.

All wireless telecommunications facilities shall be secured to prevent unauthorized access. Such security measures may include, but not be limited to, fencing, locks, and other appropriate measures as determined by the Town.

Respond within 60 days to a request for information from a potential shared-use applicant.
No signage shall be permitted on any wireless telecommunications facility except as required by law or regulation, including, but not limited to, warning signs and equipment identification signs.
