  • Decommissioning agreement required

    Prior to approval of a conditional use permit, the applicant/owner shall enter into a written decommissioning agreement with the city to be implemented upon abandonment of, or cessation of activities at, the battery energy storage system.

  • Financial assurance required

    The applicant/owner shall provide the city with financial assurance based upon the estimated costs for decommissioning as required herein.

  • Layered fire protection required

    Any battery energy storage system shall include a sufficient layered fire protection approach, as determined by the Chesapeake Fire Department, which may include, without limitation:

  • Maximum lighting above background at lot line0.5 footcandles

    All onsite lighting shall be arranged and installed so that the direct or reflected illumination does not exceed one-half (0.5) footcandles above background measured at the lot line of any adjoining property.

  • Any battery energy storage system shall be setback three hundred (300) feet from all property lines.

  • City council may reduce the distance required by this section to a distance of no less than one hundred (100) feet if:
