Height

No construction of towers, mono-poles, or other similarly tall structures that would violate the zones of this Ordinance shall commence within twenty thousand (20,000) feet of the runway until FAA Form 7460-1 has been completed and reviewed by the FAA.
- High ground exception
Parcels with existing ground elevation greater than 400 feet MSL, as shown on Brandy Station USGS map, are exempt from height restrictions and subject only to underlying zoning and proffers.
Existing nonconforming structures or vegetation are allowed to continue, but may be required to permit installation of markers and lights at airport owner's expense.

No use may be made of land or water in such a manner as to: create electrical interference with navigational signals or radio communication; diminish ability of pilots to distinguish airport lights; result in glare; impair visibility; create potential for bird strike hazards; or otherwise endanger or interfere with aircraft operations.
Variances may be granted by the Board of Zoning Appeals, with determinations from Virginia Department of Aviation and FAA, and must be acted on within 120 days.
