  • Decommissioning agreement required

    Prior to approval of conditional use permit, applicant shall enter into written decommissioning agreement with city.

  • Financial assurance required

    Applicant shall provide financial assurance based on estimated decommissioning costs, in form of certified funds, cash escrow, bond, or irrevocable letter of credit.

  • Layered fire protection required

    Shall include sufficient layered fire protection approach as determined by Chesapeake Fire Department, including access, water sources, fire walls, monitoring, etc.

  • Lighting limit at lot line0.5 footcandles

    All onsite lighting shall be arranged so that direct or reflected illumination does not exceed one-half (0.5) footcandles above background measured at the lot line of any adjoining property.

  • Any battery energy storage system shall be setback three hundred (300) feet from all property lines.

  • City council may reduce the distance to no less than one hundred (100) feet if independent risk analysis provided and safety features identified.

  • Transfer of ownership notification

    Within 30 days of change in at least 50% ownership, owner shall notify zoning administrator and city council.

  • Underground transmission lines preferred

    Whenever feasible, onsite transmission or power lines shall be placed underground.
