  • Abandonment period90 days

    Wireless telecommunications facilities with a permit have been abandoned (i.e., not used as wireless telecommunications facilities) for a period exceeding 90 consecutive days or a total of 180 days in any 365-day period

    A violation of this article is hereby declared to be an offense, punishable by a fine not exceeding $350.00 or imprisonment for a period not to exceed six months, or both, for conviction of a first offense

  • Indemnification required

    Any application for wireless telecommunication facilities that is proposed for town property, pursuant to this article, shall contain a provision with respect to indemnification.

  • Insurance delivery deadline15 days

    Before construction of a permitted wireless telecommunications facilities is initiated, but in no case later than 15 days after the grant of the special use permit, the holder of the special use permit shall deliver to the town a copy of each of the policies or certificates representing the insurance in the required amounts.

  • Relief process

    Any applicant desiring relief or exemption from any aspect or requirement of this article may request such from the council at a preapplication meeting

  • Wireless telecommunications facilities require a special use permit.

  • State/federal compliance

    the holder of such a special use permit shall adhere to, and comply with, all applicable rules, regulations, standards, and provisions of any state or federal agency, including, but not limited to, the FAA and the FCC.

  • Violation notice

    If wireless telecommunications facilities are repaired, rebuilt, placed, moved, relocated, modified or maintained in a way that is inconsistent or not in compliance with the provisions of this article or of the special use permit, then the council shall notify the holder of the special use permit in writing of such violation.
