  • Annual evidence of compliance

    The applicant must provide evidence of compliance with this section to the county one year after the date of installation, and every year thereafter, as long as the structure remains on the property.

  • Comply with Virginia Department of Health requirements

    The applicant must comply with all applicable Virginia Department of Health requirements.

  • Maximum number of structures per lot1 count

    Only one such structure shall be allowed on a lot.

  • Removal within 30 days after need ends30 days

    The structure shall be removed within 30 days after the mentally or physically impaired person is no longer receiving, or is no longer in need of, the assistance provided for in this section.

  • Zoning clearance required

    Any person proposing to install the structure shall first obtain a zoning clearance.

Signage

  • No signage advertising the structure

    No signage advertising or otherwise promoting the existence of the structure shall be permitted anywhere on the property.

From the ordinance

Temporary family health care structures shall be a permitted accessory use in any single family residential district on lots zoned for single family detached dwellings if the structure (i) is used by a caregiver in providing care for a mentally or physically impaired person; and (ii) is on property owned or occupied by the caregiver as his residence.
