- Application procedure
A request for a conditional use permit may be submitted to the board of supervisors through the zoning administrator by the property owner, or optionee. A site plan shall accompany the request. The zoning administrator reviews, planning commission holds public hearing, board of supervisors decides.
- Conditions and bonds
The board may impose conditions such as abatement of noise, smoke, dust, vibration, glare, odors, wastes; more stringent setbacks; adequate parking; buffer landscaping; time limits for expiration (residential and electrical generation projects valid for no fewer than three years); may require bond.
- Notice requirements
Prior to the public hearing, written notification shall be provided to the owners of abutting property, property immediately across the street, and the property that is the subject of the conditional use permit application. No conditional use permit shall be considered by the planning commission within 14 days of any such notice.
- Permit expiration
Unless otherwise specified, any conditional use permits granted by the board of supervisors shall expire one year after the date of issuance unless substantial construction or use has actually commenced and is progressing toward completion.
- Reconsideration
A property owner or other applicant who has been denied a conditional use permit may not submit substantially the same application until after a period of at least 12 months from the date of the original denial.
- Review standards
Review standards include: proposed use appears on official schedule; will not adversely affect health/safety; will not change character of district; conformance with chapter and comprehensive plan; adequate utilities, access roads, drainage; ingress/egress to minimize traffic congestion; conforms to applicable zoning district regulations.
