Earthen berms may be required as determined by the zoning administrator in order to protect environmentally sensitive areas and open waters from poultry litter runoff.

Confined poultry operations are allowed by right as a permitted use only in the agricultural zoning district.

Existing confined poultry operations not meeting minimum acreage and/or setback requirements are considered nonconforming uses/structures so long as use not interrupted for more than two years. If discontinued for longer than two years, may not recommence unless requirements met, or special use permit from board of appeals.

Confined poultry operations must obtain a Virginia Pollution Abatement Permit for poultry waste management from the Department of Environmental Quality, in accordance with Virginia law. A Virginia Pollutant Discharge Elimination System Permit may also be required. A nutrient management plan is required for approval by the Virginia Department of Conservation and Recreation.

Care should be taken in the site selection process for a confined poultry operation regarding traffic safety and existing road conditions.

A minimum of three staggered rows of plant materials shall be placed at a width of ten to 20 feet between rows from closest to the poultry operation outwards: row closest consists of evergreen trees/shrubs, deciduous trees/shrubs or suitable grasses; middle row consists of deciduous trees; row furthest consists of evergreen trees. All required vegetative buffers shall be preserved and maintained. Dead or dying materials replaced within six months.
