• No consumption within distance of cultivation area100 ft

  Consumption of commercial cannabis shall not be allowed within one hundred feet of the commercial cultivation area.

• Wait period after denial before new application6 months

  no new application(s) for a permit on premises where an application to renew a permit has been denied shall be accepted for a period of six months from the date of denial

• Renewable energy requirement100 pct

  Electrical power ... shall be provided by one hundred percent renewable energy source or on-site zero net energy renewable source.

• Wait period after initial denial before new application12 months

  No new application(s) for a permit on premises where an application has been denied shall be accepted for a period of one year from the date of denial.

• Maximum new permits per year5 permits

  The town may issue up to five new permits during the first year of this ordinance. During the second year following the effective date of this ordinance, and each year thereafter, the town may issue up to five new permits

• Maximum number of permits in effect10 permits

  there shall be no more than ten issued permits in effect at any one time

• Maximum number of plants12 plants

  A maximum of twelve plants may be grown on the premises for commercial purposes.

  A permittee shall provide the department with notice in writing ... within twenty-four hours of the following:

• Ownership requirement

  Permittee must have his or her primary domicile in the town of Portola Valley and must own the premises.

• Penalty multiplier for violations3 x

  any permittee found to be in violation of this chapter shall be assessed ... a penalty in the amount of three times the amount of the permit fee.

• Record retention period7 years

  A permittee shall keep and maintain the following records for at least seven years from the date of permit issuance by the town

• Permit renewal application deadline60 days

  a completed permit renewal application ... shall be received by the department no fewer than sixty calendar days before the expiration of the permit

• Notification to adjacent property owners before renewal30 days

  the department shall notify all adjacent property owners of the submittal at least thirty days prior to the issuance of the renewal

• Residency requirement

  Permittee must have his or her primary domicile in the town of Portola Valley and must own the premises.

• Minimum distance from sensitive receptor600 ft

  All premises shall also be located a minimum of six hundred feet from any sensitive receptor.

• Maximum waste accumulation period7 days

  No garbage and refuse generated in conjunction with the cultivation of cannabis shall be allowed to accumulate for more than seven calendar days
