ARTICLE 50#

ENFORCEMENT#

50.1 - Enforcement.#

A.

Responsibility for the enforcement of this ordinance shall be with the Zoning Administrator, under the direction of the Planning Director. All officials, employees, and departments of the City shall assist the Zoning Administrator and shall issue no permit, certificate, or license for any use, building, structure, or purpose in conflict with the provisions of this ordinance.

B.

It shall be the responsibility of the Building Official to enforce the provisions of this ordinance in connection with the issuance of permits for the erection, construction, moving, alteration, or reconstruction of any building or structure.

C.

Every permit, certificate, or license issued by any official, employee, or department of the City in conflict with the provisions of this ordinance shall be null and void.

50.2 - Violation a Public Nuisance.#

Any building or structure set up, erected, constructed, altered, enlarged, converted, moved, or maintained contrary to the provisions of this ordinance, and any use of land, building, or premise established, conducted, operated, or maintained contrary to the provisions of this ordinance, shall be, and the same is hereby declared to be unlawful and a public nuisance.

50.3 - Duty of City Attorney.#

The City Attorney of the City shall, upon order of the Council, immediately commence action or proceedings for the abatement and removal and enjoinment of any violation of this ordinance, in the manner provided by law, and shall take such other steps and shall apply to such courts as may have jurisdiction to grant such relief as will abate and remove such building or structure and restrain and enjoin any person, firm, or corporation from setting up, erecting, building, maintaining, or using any such building or structure or using property contrary to the provisions of this ordinance.

50.4 - Remedies Cumulative.#

The remedies provided for herein shall be cumulative and not exclusive.

50.5 - Violation an Infraction.#

A.

Any person, firm, or corporation, whether as principal, agent, employee, or otherwise, violating or causing the violating of any of the provisions of this ordinance shall be guilty of an infraction and, upon conviction thereof, shall be punishable by:

  1. A fine not exceeding one hundred dollars ($100.00) for a first violation.

  2. A fine not exceeding two hundred dollars ($200.00) for a second violation of the same provision within one (1) year.

  3. A fine not exceeding five hundred dollars ($500.00) for each additional violation of the same provision within one year.

B.

The Zoning Administrator, under the direction of the Planning Director, shall enforce the provisions of this ordinance and shall have the authority to issue citations for violations of the provisions of this ordinance.

50.6 - Each Day a Separate Offense.#

Each day during any portion of which any violation of this ordinance is committed or continued by such person, firm, or corporation shall constitute a separate offense and shall be punishable as herein provided.
