Sec. 3B.1. - Purpose and intent.#
It is the purpose and intent of this article to provide rules and regulations governing the conduct of all operations at the Oceanside Municipal Airport.

Sec. 3B.2. - Short title.#
This article shall be known and may be cited as the "Oceanside Municipal Airport Rules and Regulations."

Sec. 3B.3. - Application.#
The provisions of this article apply only to the Oceanside Municipal Airport.

Sec. 3B.4. - Definitions.#
For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
Aircraft means any manned contrivance used or designed for navigation of, or flight in, the air requiring certification and regulation as prescribed by federal statute or regulation. Notwithstanding the foregoing provisions of this section, manned lighter-than-air balloons and ultralight vehicles as defined in the regulations of the Federal Aviation Administration (14 C.F.R. Part 103), whether or not certified by the Federal Aviation Administration, shall not be considered to be aircraft for the purposes of this article.
Air operations area means any portion of the airport which is used or intended to be used for the landing, take off, and surface maneuvering of aircraft, including unimproved ground adjacent to such areas.
Airport means the Oceanside Municipal Airport owned and operated by the City of Oceanside.
Airport manager means that person or entity designated by the city and his or her authorized assistants, employees and representatives.
City means the City of Oceanside, a municipal corporation, and its governing city council.
Field operations area means that area within the boundaries of the airport not open to the general public, including aircraft parking areas, aircraft tie down areas and tee hangars, aircraft fueling areas, aircraft operating areas, storage areas, certain sidewalks and buildings, and any other area so designated by the airport manager.
Fire chief means the fire chief of the city and his authorized assistants, deputies, employees and representatives.
Mobile equipment means any nonself-propelled vehicle or device in which persons or property may be transported.
Motor vehicle means any self-propelled vehicle.
Operation of aircraft includes taxiing, flying and sitting at the controls of an aircraft while the engine is running or while the aircraft is moving or being moved.
Permit means written permission of the airport manager to engage in a specified activity at the airport.
Person means any individual, firm, partnership, joint venture, corporation, company, association, includes any trustee, receiver, assignee, or similar representative thereof.
Public area means any area of the airport so designated by the airport manager with unobstructed access to the public. All field and air operations areas as defined herein are not public areas.

Sec. 3B.5. - Incorporation of Uniform Fire Code.#
The provisions of the most recent edition of the Uniform Fire Code applicable to the airport and airport operations are incorporated herein by reference. The Uniform Fire Code, latest edition, shall be enforced pursuant to the provisions of this article.

Sec. 3B.6. - Powers and duties of the airport manager.#
(a) The airport manager shall be appointed by the city manager and shall be in charge of and regulate all activities and operations carried on at the airport including, but not limited to, maintenance and upkeep of the airport, regulation of use of aircraft, regulation of vehicles used on the airport, regulation of business and commercial activities at the airport, providing the public with flight information, and enforcement of federal, state and city rules and regulations.
(b) Whenever a power is granted to, or a duty is imposed upon the airport manager, that power may be exercised or that duty may be performed by a duly authorized employee, agent or representative of the airport manager.

Sec. 3B.7. - Powers of fire chief.#
The fire chief shall enforce the provisions of the Uniform Fire Code applicable to the airport and operations on the airport. The fire chief shall conduct fire safety inspections on the airport with regard to the handling and storage of all materials and equipment used on the airport and the condition and usage of all fire protection devices. The fire chief shall also approve all safety provisions for the protection of persons and property on the airport. All directives issued by the fire chief shall be complied with by all persons without delay.

Sec. 3B.8. - Operation of motor vehicles.#
(a) All persons who operate motor vehicles on the airport premises shall do so in accordance with all applicable federal, state and city rules and regulations.
(b) Only motor vehicles and mobile equipment authorized by the airport manager shall be operated in the field operations area of the airport.
(c) The airport manager may set and post the motor vehicle speed limit for all areas of the airport, but in no event shall any person operate a motor vehicle on any part of the airport in a manner or at a speed which is not reasonable and prudent, and in no event at a speed in excess of ten (10) miles per hour except in the case of an emergency.§
(d) No person shall operate a motor vehicle on the airport contrary to the directions of any posted regulation.
(e) The operators of all motor vehicles shall yield to all moving aircraft. The operator of any motor vehicle passing any moving aircraft shall do so in a safe manner.
(f) When parking adjacent to a runway all motor vehicles shall be parked parallel to and off the runway and outside the runway lights a minimum of one hundred fifty (150) feet.§
(g) While backing motor vehicles or mobile equipment carrying gasoline or other fuel, the driver of such vehicle shall remain completely in the vehicle at all times.
(h) Emergency conditions existing on the field or air operations areas shall not operate to cancel any existing regulations as to motor vehicles not involved in the emergency and during such emergency conditions drivers of motor vehicles not involved in the emergency shall remain a safe distance away from the emergency area.

Sec. 3B.9. - Movement of vehicles.#
The airport manager shall have the authority to move any motor vehicle or mobile equipment at the expense of the owner or operator thereof when it is parked on the airport in violation of any rule or regulation or when such motor vehicle or mobile equipment creates an unsafe condition.

Sec. 3B.10. - Motor vehicle licensing and insurance.#
No person shall operate a motor vehicle on the airport which is not properly licensed, registered and insured pursuant to state law.§

Sec. 3B.11. - Motor vehicle lighting.#
All motor vehicles and mobile equipment operated on the airport shall be equipped with adequate headlights and taillights and shall be kept lighted while in operation after sunset.§

Sec. 3B.12. - Vehicle reflectors.#
All motor vehicles and mobile equipment authorized to operate in the field area shall be equipped with two (2) reflectors on the rear of such vehicle in addition to all other required equipment.§ Reflectors shall be red on motor vehicles and amber on mobile equipment and shall be visible from a distance of at least five hundred (500) feet under normal conditions.§

Sec. 3B.13. - Vehicle safety.#
All motor vehicles and mobile equipment located or operated on the airport shall be constructed, loaded, equipped and maintained in a safe condition.§

Sec. 3B.14. - Grounding.#
All motor vehicles and mobile equipment dispensing fuel shall have in use an adequate grounding system at all times while dispensing fuel or otherwise servicing aircraft.§

Sec. 3B.15. - Vehicle operation in hangar.#
No person shall operate a motor vehicle in any hangar without adequate ventilation or exhaust protection and the permission of the hangar owner or lessee.§

Sec. 3B.16. - Repair of vehicles.#
No person shall repair or cause to be repaired any motor vehicle or vehicles or mobile equipment at any place on the airport other than a place designated by the airport manager for such repairs.§

Sec. 3B.17. - Vehicle parking.#
No person or persons shall park or cause to be parked any motor vehicle or vehicles or mobile equipment on the airport premises in any area other than those areas designated by the airport manager for parking.§ The airport manager may designate certain areas for parking of certain classes of motor vehicles or mobile equipment, or parking by certain designated persons, companies, corporations or other entities as the airport manager may deem necessary and appropriate. Vehicles parked in violation of this article may be removed at the owner's cost pursuant to Vehicle Code section 22650 et seq.

Sec. 3B.18. - Abandoned, wrecked, dismantled or inoperative vehicles.#
The city may abate and remove any abandoned, wrecked, dismantled, or inoperative motor vehicle or vehicles, mobile equipment, or parts thereof from the airport at the expense of the owner thereof pursuant to Vehicle Code section 22660 et seq. and Article II of Chapter 17 of the Oceanside City Code. For the purposes of this section, an abandoned vehicle is any motor vehicle or vehicles, or mobile equipment, parked on the airport for a period of seventy-two (72) consecutive hours or more without the prior approval of the airport manager.§

Sec. 3B.19. - Vehicle parking limits and fees.#
The airport manager shall have the authority to establish time limits and designate fees for the parking of motor vehicles or mobile equipment on any area of the airport; such fees shall be paid as directed by the airport manager.

Sec. 3B.20. - Accident reports.#
The operators of all motor vehicles or mobile equipment which are involved in an accident on the airport shall make a detailed written report thereof to the airport manager and to the Oceanside Police Department within ten (10) days of the date of such accident.§ All such reports shall include the names and addresses of all persons involved in and witnesses to the accident.

Sec. 3B.21. - Aircraft activity.#
All aircraft operated in and around the airport whether in the air or on the ground shall be operated in accordance with all federal, state and local laws, rules and regulations.

Sec. 3B.22. - Use of airport.#
The airport manager shall have the authority for good cause appearing to him to deny any person admission to the airport by any reasonable means.

Sec. 3B.23. - Business or commercial activity.#
No person shall engage in any business or commercial activity of any nature on the airport unless authorized by the city.§

Sec. 3B.24. - Commercial photography.#
No person shall take still, motion or sound pictures or recordings for commercial purposes on the airport without permission of the airport manager.§

Sec. 3B.25. - Vehicles for hire.#
No person shall operate or cause to be operated any motor vehicle or vehicles or mobile equipment for hire on or from the airport unless such operation is with the approval of the airport manager and under such terms and conditions as the city and airport manager may prescribe.§
