Chapter 10 - BICYCLES#

Sec. 10-1. - Defined.#

The term "bicycle," for the purpose of this chapter, shall mean and include every device upon which or in which a person may ride, which is propelled by human power and which has at least two (2) tandem wheels and is connected to a frame. Such term shall also include pedal bicycles with helper motors rated less than one (1) brake horsepower, which produce only ordinary pedaling speeds up to a maximum of twenty (20) miles per hour.

Sec. 10-2. - Violations of chapter.#

Except as otherwise specifically provided, any person violating any of the provisions of this chapter shall be guilty of a Class 4 misdemeanor.

Sec. 10-3. - Registration required.#

It shall be unlawful for any person to operate or use a bicycle upon any of the streets or public highways of the city without first obtaining a certificate of registration from the city treasurer.

Sec. 10-4. - Registration plates and cards generally.#

The city shall provide metallic bicycle registration plates and seals, together with registration cards. The metallic registration plates and corresponding registration cards are to be numbered in numerical order, beginning with number "one." The design and identification lettering on such plates are to be approved by the city treasurer. It shall be the duty of the city treasurer to issue such metallic registration plate and to issue a corresponding registration card to the owner of a bicycle upon the payment of the registration fee herein required. Such metallic registration plate shall be attached to the frame of the bicycle for which it was issued by the owner, and such plate shall remain thereon during the period such bicycle is operated within the city. The city treasurer shall keep a permanent register in which shall be entered the name, address and age of the owner of each registered bicycle, the date of registration and other sufficient information to identify such bicycle.

Sec. 10-5. - Registration fee; duplicate plate or card.#

The registration fee to be paid for each bicycle registered under this chapter shall be thirty-five cents ($0.35). Such fee shall cover all charges incident to registration and the issuance of registration plates and cards. In the event of the loss of a registration plate or card, a duplicate may be issued at the cost of thirty-five cents ($0.35).

Sec. 10-6. - Altering, removing, etc., frame number or registration plate or card.#

It shall be unlawful for any person willfully or maliciously to remove, destroy, mutilate or alter the number of any bicycle frame registered pursuant to this chapter. It shall also be unlawful for any person willfully or maliciously to remove, destroy, mutilate or alter any registration plate or registration card issued pursuant to the provisions of this chapter during the time in which the bicycle for which such registration plate or card was issued is operated; provided, however, that nothing in this chapter shall prohibit the city treasurer from stamping a number on the frame of a bicycle on which no serial number can be found or on which such number is illegible or insufficient for identification purposes.

Sec. 10-7. - Transfer of ownership.#

It shall be unlawful for any person to sell or transfer ownership of any bicycle without reporting to the city treasurer, within forty-eight (48) hours from the time thereof, full and complete information relative to such transfer, so that such bicycle may be registered in the name of the transferee. The purchaser or transferee of any such bicycle shall apply for a transfer of registration therefore within five (5) days from the time the same is acquired by him.

Sec. 10-8. - Reports by secondhand dealers.#

It shall be unlawful for any person engaged in the business of buying secondhand bicycles, or any parts of secondhand bicycles, to fail to report to the city treasurer within forty-eight (48) hours after acquiring any second-hand bicycle, or parts thereof. Such report shall include the registration number of such bicycle, a description of the bicycle acquired, the frame number thereof, together with the name and address of the person from whom the same was acquired. In case of the purchase of any parts of a bicycle, the report shall describe each part and shall give the name and address of the person from whom acquired.
